Explanation
This legislation authorizes the Finance and Management Director to enter into a contract with Xylem Water Solutions USA, Inc. for the purchase of a Flygt Effluent pump and service for the Divisiosn of Sewerage and Drainage, Jackson Pike Wastewater Treatment Plant. The pump will serve as a spare for Effluent Pumps #4 and #5 due to current pumps being 15 years old and recent failures of pumps 4 and 5. These pumps are required to maintain maximum treatment of 150 MGD. This contract for the pump, associated parts, along with the start-up charge, warranty and service support will be established in accordance with the relevant provisions of Chapter 329 of City Code relating to Sole Source procurement.
Xylem Water Solutions USA, Inc. is the Sole manufacturer for Flygt equipment. Xylem Inc., located in Milford, Ohio is the authorized sales representative and Flygt certified repair facility which will provide start up, warranty and service support for this territory. Although there is a current UTC for parts and service it does not include the purchase of complete pumps. An informal quote was received from Xylem Water Solutions USA, Inc. detailing the cost of the pump, additional parts and the service fees. See attached letter.
This Ordinance is being submitted in accordance with the relevant provisions of Chapter 329 of City Code pertaining to Sole Source procurement.

Xylem Water Solutions USA, Inc. does not hold MBE/FBE status.
The company is not debarred according to the Excluded Party Listing System of the Federal Government or prohibited from being awarded a contract according to the Auditor of State Unresolved Findings for Recovery Certified Search.
FISCAL IMPACT: A total of $117,476.03 is requested and budgeted for this expenditure.
