Title: To authorize the Finance and Management Director to enter into two (2) Universal Term Contracts for the option to purchase the Rental and Maintenance of Portable Toilets with United Rentals North America Inc. and Johnny on the Spot LLC; to authorize the expenditure of $2.00; and to declare an emergency. BACKGROUND: This legislation authorizes the Finance and Management Director to establish two (2) Universal Term Contracts (UTC) for the option to purchase Rental and Maintenance of Portable Toilets with United Rentals North America Inc. and Johnny on the Spot LLC. The Department of Recreation and Parks is the primary user for the Rental and Maintenance of Portable Toilets. Portable Toilet Rentals are used in the City Parks, Golf Courses and Special Events to provide portable toilet and hand washing facilities to these venues and events. The term of the proposed option contract would be approximately two (2) years, expiring December 31, 2024, with the option to renew for an additional two (2) one year periods. The Purchasing Office opened formal bids on October 6, 2022. In addition, the expenditure of $2.00 is hereby authorized from General Budget Reservation BRPO002025.

The Purchasing Office advertised and solicited competitive bids in accordance with the relevant provisions of Section 329.06 relating to competitive bidding (Request for Quotation No. RFQ022769). Three (3) bids were received.

The Purchasing Office is recommending award to the overall lowest, responsive, responsible and best bidders as follows:

United Rentals North America Inc, CC# 010565 expires 10/4/2024, Category 1, Category 2 and Category 3, $1.00
Johnny on the Spot LLC, CC# 043126 expires 9/27/2024, Category 3, $1.00

Total Estimated Annual Expenditure: $380,000.00, Department of Recreation and Parks is the primary user.

Emergency Designation: The Finance and Management Department respectfully requests this legislation to be considered an emergency ordinance because in light of the existing supply chain issues the awarded vendors need time to plan and secure materials with such action being in the best interest of the City.
