Explanation

 

BACKGROUND:  This ordinance authorizes the Director of the Department of Public Safety, on behalf of the Division of Support Services, to enter into a contract with Motorola Solutions Inc. to upgrade to 800 MHz radios used by the Public Safety forces. The City has approximately 1,500 radios that need to be upgraded to a new standard. Upgrading these radios is not only less expensive than the purchase of new radios, but will also ensure that the all 800 MHz radios on the statewide system have proper security protocols and two factor authentication.

 

Bid Information: This upgrade is being executed in accordance with the sole source provisions of Chapter 329 of the Columbus City Codes. Motorola radios require proprietary software and infrastructure owned by Motorola Solutions Inc.  No other vendor has access to Motorola source code and Motorola has not authorized any dealer or other party to obtain such access

Emergency Designation: Emergency designation is requested to ensure the continued operation and to ensure that the deadline for support is met.

 

FISCAL IMPACT:  This ordinance authorizes an expenditure of $208,125.00 with Motorola for the upgrade of city of 800 MHz radios.  Funding for this expenditure is available in Support Services’ 2023 general fund appropriation.

Body

WHEREAS, the Division of Support Services is responsible for the acquisition and maintenance of the 800 MHz radios used by Public Safety forces; and,

 

WHEREAS, the Division of Support Services has a need to enter into contract with Motorola for the software upgrade to these radios in order to maintain maintenance support from Motorola and meet the statewide security protocols; and,

 

WHEREAS, Motorola is the only known company that can provide the maintenance and support for these systems; and,

 

WHEREAS, the contract is being entered into under the Sole Source Provision of Chapter 329 of the Columbus City Codes; and,

 

WHEREAS, an emergency exists in the usual daily operations of the Department of Public Safety, Division of Support Services, in that it is immediately necessary to authorize the Director of Public Safety to enter into contract with Motorola Inc. to upgrade 800 MHz radios, thereby preserving the public peace, health, property, safety, and welfare; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the Director of Public Safety be and is hereby authorized and directed to enter into contract with  Motorola Inc. for the upgrade of 800 MHz radios.

 

SECTION 2.  That the expenditure of $208,125.00, or so much thereof as may be necessary in regard to the action authorized in SECTION 1, be and is hereby authorized from Fund 1000 per the accounting codes in the attachment to this ordinance.

 

SECTION 3.  That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 4.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

SECTION 5.  That the above contract is hereby made in accordance with the Sole Source procurement provisions of Chapter 329 of the Columbus City Code.

 

SECTION 6.  That for the reasons stated in the preamble hereto, which is hereby made a part thereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
