1.  BACKGROUND

This ordinance authorizes the Director of Public Utilities to enter into a professional design services contract with Burgess & Niple for the Alum Creek Trunk - Middle (Phase D) Sewer Rehabilitation project, CIP No. 650725-100029, in an amount up to $1,208,612.84. 

 

This project will provide professional design services of the rehabilitation of approximately 14,395 lineal feet of 84" and 90" reinforced concrete pipe that has been determined to be in poor condition through direct CCTV and man entry observations.  The scope of work includes production of a detailed design summary memo, the production of construction drawings and specifications, environmental permitting, bid phase services, and services during construction.

 

This work will be performed in Columbus Community Area 41 - Northeast.

 

TIMELINE & FUTURE RENEWALS

The contract and associated scope of services will be performed by the contractor until the scope of services is completed to the satisfaction of the Department of Public Utilities.  The contract may be renewed and/or modified by the Department of Public Utilities with concurrence of the contractor and the approval of City Council.

2.  ECONOMIC IMPACT/ADVANTAGES; COMMUNITY OUTREACH; PROJECT DEVELOPMENT; ENVIRONMENTAL FACTORS/ADVANTAGES OF PROJECT

This project will rehabilitate a sewer that is in poor condition thereby reducing the risk of potential collapse and the resulting overflows that may occur to homes or receiving streams.

 

3.  PROCUREMENT

The Department of Public Utilities advertised a Request for Proposals on the Vendor Services and Bonfire websites from 1/6/2023 through 2/17/2023 in order to solicit proposals for the Alum Creek Trunk - Middle (Phase D) Sewer Rehabilitation professional design services with the intention of awarding a design contract.  Proposals were received from the following companies:

All proposals were considered responsive and were evaluated by the evaluation committee.  The company that scored the highest by the evaluation committee, Burgess & Niple, will be offered a contract upon the approval of City Council.

4.  CONTRACT COMPLIANCE INFORMATION

Burgess & Niple’s contract compliance number is CC005053 and expires 11/30/2024.

 

Searches in the Excluded Party List System (Federal) and the Findings for Recovery list (State) did not reveal any exclusions for either the Prime Consultant or any sub-consultants.

 

5.  MINORITY AND WOMAN OWNED BUSINESS ENTERPRISE & SMALL LOCAL BUSINESS ENTERPRISE PROGRAM

These contracts were bid with an anticipated City of Columbus MBE/WBE Program goal of 12% as assigned by the City’s Office of Diversity and Inclusion (ODI).  After ODI’s review of the Utilization Plan and other related information the contractors submitted with their bid responses, ODI has approved an MBE/WBE Program goal of 12% for the contract.  Failure by the contractor to meet this goal subjects the contractor to the Penalties for Non-Compliance as described in the bid documents for this contract.

6.  FISCAL IMPACT

An amendment to the 2022 Capital Improvement Budget is necessary to align budget authority with the proper projects.  A transfer of cash and appropriation within the Sanitary Bond Fund, Fund 6109 is needed to align cash and appropriation with the proper project.

Body

WHEREAS, the Department of Public Utilities advertised and received Request for Proposals for the Alum Creek Trunk - Middle (Phase D) Sewer Rehabilitation project; and

 

WHEREAS, Burgess & Niple was selected by the evaluation committee to provide these services; and

 

WHEREAS, it is necessary to authorize the Director of Public Utilities to enter into a professional design services contract with Burgess & Niple, for the Alum Creek Trunk - Middle (Phase D) Sewer Rehabilitation Project; and

 

WHEREAS, an amendment to the 2022 Capital Improvement Budget is needed to align budget authority with the proper projects; and

 

WHEREAS, it is necessary to transfer cash and appropriation within the Sanitary Bond Fund, Fund 6109 to align cash and appropriation with the proper projects; and

 

WHEREAS, funds must be expended to pay for the professional design services that Burgess & Niple will provide under the Alum Creek Trunk - Middle (Phase D) Sewer Rehabilitation contract; and now therefore,

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the 2022 Capital Improvement Budget authorized by Ordinance 1896-2022 be amended as follows to establish sufficient budget authority for this project:

SECTION 2.  That the transfer of cash and appropriation between projects within the Sanitary Bond Fund, Fund 6109, is authorized per the accounting codes in the attachment to this ordinance.

 

SECTION 3.  That the Director of Public Utilities is authorized to enter into a contract with Burgess & Niple, 330 Rush Alley, Suite 700, Columbus, OH 43215, for the Alum Creek Trunk - Middle (Phase D) Sewer Rehabilitation project, in accordance with the terms and conditions as shown in the contract on file with the Department of Public Utilities.

 

SECTION 4.  That the expenditure in an amount not to exceed $1,208,612.84 is authorized in Fund 6109, Sanitary Bond Fund, in Object Class 06, capital Outlay, per the accounting codes in the attachment to this ordinance.

 

SECTION 5.  Funds are hereby deemed appropriated and expenditures and transfers authorized to carry out the purposes of this ordinance and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 6.  That the City Auditor is authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project.

 

SECTION 7.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

SECTION 8.  That this Ordinance shall take effect and be in force from and after the earliest period allowed by law.
