Explanation

This ordinance authorizes the City Auditor to make payment to the Columbus Museum of Art for services rendered for naturalization ceremony that took place on June 13, 2023. The funds were spent on an event space, food, and beverages at the Columbus Museum of Art for a naturalization ceremony hosted by the City in partnership with the office of Chief Justice Algenon Marbley.  Attendees included petitioners, their families and guests, court staff, council staff, and museum staff.  Refreshments included a light breakfast and beverages catered by the museum and to declare an emergency.

 

City Code Section 329.35 permits the purchase of food and beverages for a public purpose and permits the use of funds for community programs and events sponsored by the City.  The expenditure of public funds was an integral part of the success of the naturalization ceremony.

 

FISCAL IMPACT: Funding in the amount of $5,998.00 is available and appropriated for the payment of this expenditure in Fund 1000, subfund 100018 within Columbus City Council as noted in the attached “Then and Now Certificate” as approved by the City Auditor. 

EMERGENCY PASSAGE: Passage by emergency is requested in order to meet the requirements of R.C. Section 5705.41(D)(1) so that payment can be made within thirty days of receiving the Then and Now Certificate.

To authorize and direct the City Auditor to authorize payment to the Columbus Museum of Art per invoice approved by the City Clerk in an amount not to exceed $5,998.00 from the general fund on PO392230; and to declare an emergency. ($5,998.00). 

Body

WHEREAS, the Columbus Museum of Art provided goods or services to the City of Columbus for a naturalization ceremony that took place on June 13, 2023, and,

WHEREAS, after these goods or services were rendered, the City received an invoice from the Columbus Museum of Art for which a purchase order, with a prior certification of availability of funds by the City Auditor attached, had not been obtained; and,

WHEREAS, Section 5705.41 (D)(1) of the Ohio Revised Code provides that in certain circumstances a political subdivision may authorize payment on a contract executed without prior certification by the City Auditor; and,

WHEREAS, the City Council now has before it a certificate from the City Auditor certifying there was at the time of making the contract and at the time of the execution of such certificate a sufficient sum appropriated for the purpose of such contract and in the treasury or in process of collection to the credit of an appropriate fund free from any encumbrances (a “then and now certificate”); and,

WHEREAS, less than thirty days have passed since the City Council’s receipt of the certificate from the City Auditor; and,

WHEREAS, the expenditure of City funds for the purchase of food and beverages, and the rental of space at the Columbus Museum of Art, was for a public purpose and was an integral part of the success of the naturalization ceremony; and

WHEREAS, City Council desires to satisfy the obligations of the amount owed; and

WHEREAS, an emergency exists in the daily operations of Columbus City Council in that it is immediately necessary to present this ordinance for the City Auditor to issue a warrant in accordance with the Ohio Revised Code Section 5705.41 (D)(1) and within the thirty-day time-frame permitted by that statute, all for the preservation of the public peace, property, health safety and welfare; now, therefore

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

SECTION 1.   City Council finds that the expenditure of City funds to co-sponsor a Naturalization Ceremony on June 13, 2023, at the Columbus Museum of Art, was for a public purpose and such expenditure was an integral part of the success of that ceremony, and such expenditure was not manifestly arbitrary or unreasonable, and permitted by City Code Section 329.35.

SECTION 2.  City Council acknowledges receipt of the Then and Now Certificate from the City Auditor and authorizes and directs the City Auditor to authorize payment per invoice(s) approved by the City Clerk in an amount not to exceed $5,998.00 to the Columbus Museum of Art on PO392230.

SECTION 3.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approved by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
