Explanation

 

BACKGROUND

This ordinance authorizes the Administrative and Presiding Judge of the Franklin County Municipal Court to accept a grant in the amount of $15,000.00 from the Ohio Environmental Protection Agency, and to appropriate from the unappropriated balance of the general government grant fund to the Probation Department of the Franklin County Municipal Court, the total amount of the grant.  This grant will provide disposal fees for tires and trash.

 

Emergency Legislation is requested because tires and trash will continue to accumulate in alleys creating a public health nuisance and the start date for the grant is July 1st, 2023.

 

FISCAL IMPACT

$15,000 will be expended from the General Government Grant Fund.

To authorize and direct the Administrative and Presiding Judge of the Franklin County Municipal Court to accept a grant award from the Ohio Environmental Protection Agency to provide for disposal fees for tires and trash; to appropriate $15,000.00 from the unappropriated balance of the general government grant fund to the Franklin County Municipal Court; and to declare an emergency. ($15,000.00)

 

Body

 

WHEREAS, a grant from the Ohio Environmental Protection Agency in the amount of $15,000 has been awarded to provide support to the Franklin County Municipal Court Community Service Program with the purpose of improving the community, reducing litter and illegal dumping in public areas and providing litter prevention awareness; and

 

WHEREAS, the Administrative and Presiding Judge of the Franklin County Municipal Court desires to accept this grant award; and

 

WHEREAS, an emergency exists in the usual daily operation of the city, in that it is immediately necessary to authorizes the Administrative and Presiding Judge of the Franklin County Municipal Court to accept the aforementioned grant to provide community service supplies, disposal fees, and outreach materials and to pick-up tires and debris immediately to avoid a public health nuisance, and so that the grant funds can be used as close to the start date of July 1st, 2023,  as possible, thereby preserving the public health, peace, property, safety and welfare; Now, Therefore,

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1. That the Administrative and Presiding Judge of the Franklin County Municipal Court is authorized to accept a grant in the amount of $15,000.00 from the Ohio Environmental Protection Agency.

 

SECTION 2. Funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated.  That from the unappropriated balance in the general government grant fund, fund 2220, and from all monies estimated to come into said fund from any and all sources and appropriated for any other purpose during the months ending June 30, 2024, the sum of $15,000.00 is appropriated to the Franklin County Municipal Court.

 

SECTION 3. That the monies appropriated in the foregoing Section 2 shall be paid upon the order of the Administrative and Presiding Judge of the Franklin County Municipal Court and that no order shall be drawn or money paid except by voucher, the form of which shall be approved by the City Auditor.

 

SECTION 4.  That from the unappropriated monies and from all monies estimated to come into said fund from any and all sources and unappropriated for any other purpose during the fiscal year ending 06/30/2024 any additional awarded funds are appropriated in Fund 2220 according to notification of award or grant agreement by the grantor.

 

SECTION 5. At the end of the grant period, any repayment of unencumbered balances required by the grant is authorized and any unused City match monies may be transferred back to the City fund from which they originated in accordance with all applicable grant agreements

 

SECTION 6.   That for the reasons stated in the preamble hereto, which is made a part hereof, this ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
