Background: The following is a resolution to declare the necessity and intent to appropriate construction easements in, over, under and through real estate in connection with the East Neil Alley Rehabilitation Project.Fiscal Impact:     N/AEmergency Justification:  Emergency action is requested to allow the Eminent Domain actions to proceed without delay thereby allowing this project to move forward.

To declare the necessity and intent to appropriate construction easements in, over, under and through real estate in connection with the East Neil Alley Rehabilitation Project, and to declare an emergency.

WHEREAS,      the City of Columbus is engaged in the East Neil Alley Rehabilitation Project; and,
 
WHEREAS,      an emergency exists in the usual daily operation of the Public Service Department, Division of Transportation, in that it is immediately necessary to declare the necessity and intent to appropriate permanent and construction easements in, over, under and through the hereinbefore described real estate necessary for the aforementioned project so that there will be no delay in the project thereby preserving the public health, peace, property, safety, and welfare; now, therefore:
 
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
      Section 1.      That this Council hereby declares the necessity and intent to appropriate construction easements in, over, under and through the following described real estate necessary for the East Neil Alley Rehabilitation Project, Project #537650, pursuant to and in accordance with the Charter of the City of Columbus, Columbus City Code (1959) Revised, Chapter 909, the Constitution of the State of Ohio and Ohio Revised Code, Chapter 719; to-wit:
 
PARCEL 4T
TEMPORARY EASEMENT
Situated in the State of Ohio, County of Franklin, City of Columbus, being in the third Quarter of Township 1, Range 18, United States Military Lands and being part of a  0.170 Acre tract conveyed to Dwight D. and Sharon Butcher by Official Record 18506 B-10 of the Recorder's Office, Franklin County, Ohio in Auditor's Parcel Number 010-044829 and being more particularly described as follows:     
      Being a parcel of land lying on the left side of the centerline of a survey for East Neil Alley, made for the City of Columbus and being located within the following described points in the boundary thereof:
      Beginning at a point in the Grantor's easterly property line and the westerly right-of-way line of East Neil Alley, said point being 10.46 feet left of centerline of survey East Neil Alley Station 1+65.18 and also being the southeast corner of Lot 48 of Elizabeth J. McMillen Subdivision as shown on Plat Book 3, Pg 334;

      Being a strip of land variable in width West of, and adjacent to the westerly right-of-way line of the alley East of Neil Avenue and North of Eighth Avenue, and being left of and between centerline of survey East Neil Alley Station 6+72.87 and Station 7+58.05  as shown on the construction plans for East Neil Alley, King Avenue to Ninth Avenue Alley Rehabilitation, plan number 1745 Dr. E and containing 365 square feet, more or less.
      Grantor claims title by instrument of record 199803090054299, Franklin County Recorder's Office, Auditor's parcel Number 010-057096.

      Section 2.      That the City Attorney be and hereby is authorized to cause a written notice of the adoption of this resolution to be served upon the owners, persons in possession of or persons having a real or possible interest of record in the above described premises in the manner provided by law.
 
      Section 3.      That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this resolution is declared to be an emergency measure and shall take effect and be in force from and after its adoption and approval by the Mayor, or ten days after adoption if the Mayor neither approves nor vetoes the same.
