Explanation

1.                     Background

The City of Columbus, Department of Public Service, received a request from the Wood Companies on behalf of the owner of the site, Russell & High LLC, asking that the City allow a fire escape to remain encroaching into the public right-of-way. This encroachment consists of one fire escape along the south side of Russell Street, west of High Street and parallel to parcel 010-015032. The project is located at the southwest corner of High Street and Russell Street at 641 N. High Street. This project is to replace, in-kind, the existing fire escape for a three (3) story building. This encroachment is located within the right-of-way as indicated above and the easement is described below and within the attached exhibit.

 

The following legislation authorizes the Director of the Department of Public Service to execute those documents necessary for the City to grant this encroachment and legally allow the fire escape to extend into the public rights-of-way. Allowing this element into the public right-of-way will allow for the building to continue to meet building requirements. A value of $500.00 for the encroachment easement was established.

 

2.                     Fiscal Impact

The City will receive a total of $500.00, to be deposited in Fund 7748, Project P537650, for granting the requested encroachment.

Body

WHEREAS, the City of Columbus, Department of Public Service, received a request from the Wood Companies on behalf of the owner of the site, Russell & High LLC, asking that the City allow a fire escape to remain encroaching into the public right-of-way. WHEREAS, this project is to replace in kind the existing fire escape for a three (3) story building. This encroachment is located within the right-of-way as indicated above and the easement is described below and within the attached exhibit; and

 

WHEREAS, a value of $500.00 was established for the encroachment easement to be deposited into fund 7748, Project P537650; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

Section 1.  That the Director of the Department of Public Service hereby authorized to execute those documents necessary for the City to grant this encroachment and legally allow it to extend into the public rights-of-way site owner, Russell & High LLC, and attached exhibits; to-wit:

 

3 Dimensional Encroachment Easement

0.0038-ACRE (164.67 SQ. FT.) VERTICAL ENCROACHMENT EASEMENT

FROM ELEVATION 753.10’ TO 783.50’ (NAVD 88)

 

Situated in the State of Ohio, County of Franklin, City of Columbus, and being part of Reservation No. Eight (8) of Lincoln Goodale’s Addition to the City of Columbus, as the same is numbered and delineated upon the recorded plat thereof, of record in Plat Book 1, Page 92 of the Recorder’s Office, Franklin County, Ohio and being further described as follows:

Beginning at the intersection of the existing southerly right of way of Russell Street (40’ Wide) and the existing westerly right of way of High Street (76’ Wide), said point also being the northeasterly corner of a 0.33-acre tract as conveyed to Russell & High, LLC by deed of record in Instrument No. 201207240106012;

Thence with the existing southerly right of way of Russell Street projected, and across the existing right of way of High Street, North 81° 40’ 51” East for a distance of 0.50 feet to a point, between elevations 753.10’ and 783.50’;

Thence across the existing right of way of High Street and Russell Street for the following five (5) courses:

1.                     Parallel to and 0.50’ easterly of the existing westerly right of way of High Street, North 08° 19’ 18” West for a distance of 5.00 feet to a point, between elevations 753.10’ and 783.50’;

2.                     Parallel to and 5.00’ northerly of the existing southerly right of way Russell Street, South 81° 40’ 51” West for a distance of 22.80 feet to a point, between elevations 753.10’ and 783.50’;

3.                     Parallel to and 22.30 feet westerly of the existing westerly right of way of High Street, North 08° 19’ 18” West for a distance of 0.50 feet to a point, between elevations 753.10’ and 783.50’;

4.                     Parallel to and 5.50 feet northerly of the existing southerly right of way of Russell Street, South 81° 40’ 51” West for a distance of 9.22 feet to a point, between elevations 753.10’ and 783.50’;

5.                     Parallel to and 31.52 feet westerly of the existing westerly right of way of High Street, South 08° 19’ 18” East for a distance of 5.50 feet to a point on the existing southerly right of way of Russell Street and the northerly line of said 0.33-acre tract, between elevations 753.10’ and 783.50’;

Thence with the existing southerly right of way Russell Street and the northerly line of said 0.33-acre tract, North 81° 40’ 51” East for a distance of 31.52 feet to the True Point of Beginning, between elevations 753.10’ and 783.50’, and containing 0.0038 acres (164.67 sq. ft.), more or less, and subject to all other legal easements and rights of way.

The above-described area shall encompass the metal staircase (including associated brackets, hardware & canopies) located along the northerly face of the building situated at 641 N High Street. The vertical limits are specifically identified as being from elevation 753.10’ to 783.50’. The existing sidewalk elevation adjacent to the building at grade is 753.1’±.

Bearings are based on the existing westerly right of way of High Street being N 08° 19’ 18” W, as referenced to State Plane Grid Coordinates, Ohio South Zone NAD83 with 2011 NSRS Adjustment.

Elevations are based on North American Vertical Datum of 1988 (NAVD 88). Source Benchmark is Franklin County Survey Control Designation "RETTKE", having an elevation of 722.45’.

This description was prepared by D. Kyle Saunders, Ohio Professional Surveyor No. 8906 from an actual field survey performed in December of 2024 by Korda/Nemeth Engineering, Inc.

 

Section 2.  That the City Attorney is required to approve all instrument(s) associated with this ordinance prior to the Director of the Department of Public Service executing and acknowledging any of those instrument(s).

 

SECTION 3. That the City will receive a total of $500.00 for granting the encroachment easement, to be deposited into Fund 7748, Project P537650.

 

SECTION 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
