Explanation

 

BACKGROUND

 

This legislation authorizes the Director of the Department of Development to modify a contract with Waterworks, LLC in an amount up to $250,000.00 to provide residential emergency repair services as part of the Division of Housing’s Emergency Repair Program.

Emergency Heating, Plumbing, and Water and Sewer Repair is part of the Emergency Repair Program, operated by the Division of Housing.  The program was established to assist low and moderate-income homeowners with heating, plumbing, and water and sewer issues that constitute an emergency condition.  Emergency repairs under this legislation will address small and large-scale capital home improvements that, if not corrected, may require the owner to vacate their home.  Most homeowners are at or below 50% AMI as defined by HUD with exceptions allowed up to 80% AMI.

 

The department advertised RFQ026104 on Vendor Services seeking contractors to provide emergency mechanical repairs on October 10, 2023 with bids being due on November 3, 2023.  The Emergency Repair Program is a home repair program operated by the Housing Division. 

In accordance with C.C. 329.09(a):

1.                     The amount of additional funds planned to be expended under this modification is $250,000.00.

2.                     The need for additional services was unforeseen at the time the initial contract was awarded due to the increase in number of emergency repairs.

3.                     It is in the City’s best interest to continue with the The Waterworks, LLC current contract to provide residential emergency heating, plumbing, and water and sewer services as part of the Division of Housing’s Emergency Repair Program, as to not interrupt current services.  This vendor has also been the only one that has submitted a bid for these services during the last 3 RFQ’s that were posted. 

4.                     The price was determined via a bid received on RFQ026104 through Vendor Services. 

 

FISCAL IMPACT:  Funding is available within the Development Affordable Housing Taxable Bond Fund. An amendment to the 2024 Capital Improvement Budget is required to establish sufficient budget authority within the proper project.

 

CONTRACT COMPLIANCE:  The Waterworks LLC, vendor number 004777 and contract compliance expires 2/11/2027.

WHEREAS, the Emergency Repair Program was established to assist low and moderate income homeowners with emergency heating, plumbing, and water and sewer services that would impact a household remaining safely in their home; and

 

WHEREAS, the Department of Development advertised the Emergency Repair Program-Residential under RFQ026104 requesting pricing from contractors to provide emergency mechanical services; and

 

WHEREAS, the contract was later modified two times to add funding and extend the contract end date under ordinances 2103-2024 and 0337-2025; and

 

WHEREAS, this legislation authorizes the Director of the Department of Development to modify a contract with The Waterworks, LLC in an amount up to $250,000.00 to provide residential emergency heating, plumbing, and water and sewer services; and

 

WHEREAS, this legislation authorizes the amendment the 2024 Capital Improvement Budget, the transfer, and expenditure of $250,000.00 as part of the Division of Housing’s Emergency Repair Program; and

 

WHEREAS, the Director of Development will modify a contract with The Waterworks LLC to carry out program repairs; and without which, residents of these households, who cannot afford the expense of services, may not be able to remain in their homes, all for the immediate preservation of the public health, peace, property, and safety; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the Director of Development be and is hereby authorized to modify a contract, in an amount up to $250,000.00, with The Waterworks LLC, to provide residential emergency heating, plumbing, and water and sewer services as part of the Division of Housing’s Emergency Repair Program.

 

SECTION 2.  That the 2024 Capital Improvements Budget be amended as follows to establish sufficient authority for this project:

SECTION 3.  That the transfer of $250,000.00 or so much thereof as may be needed, is hereby authorized within Fund 7779 (Development Affordable Housing Taxable Bond fund), Dept-Div 44-10 (Housing) per the account codes in the attachment to this ordinance.

 

SECTION 4.  That for the purpose as stated in Section 1, the expenditure of $250,000.00, or so much thereof as may be necessary, is hereby authorized in fund 7779 (Affordable Housing Taxable Bond fund), Project P782001-100000, Dept. 44-10 (Housing), in Object Class 06 (Capital Outlay) per the accounting codes in the attachment to this ordinance.

 

SECTION 5.  That the funds necessary to carry out the purpose of this ordinance are deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 6.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance

 

SECTION 7. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
