Explanation
 
1. BACKGROUND:  This legislation authorizes the Director of Public Utilities to enter into a construction contract with Kokosing Construction Co., Inc. in the amount of $32,430,000.00, for the Dublin Road Water Plant (DRWP) Treatment Capacity Increase Filter Building Rehabilitation / I & C Backbone Project, Division of Water Contract Number 1009-Part 2.
 
This contract provides for work at the Dublin Road Water Plant (DRWP) including demolition and reconstruction of existing filters including media, underdrains and troughs; providing an air filter backwash system; miscellaneous interior piping and valve modifications; miscellaneous exterior valve and piping modifications and installations; new SCADA system, including software and hardware, and I & C Backbone for the facility; demolition and reconstruction of the filter building roof; structural improvements to the filter building; painting the filter gallery; miscellaneous electrical and mechanical improvements; associated site work; provision of perimeter security throughout the project; and other such work as may be necessary to complete the contract in accordance with the plans and specifications set forth in the bid submittal documents.
 
2. ECONOMIC IMPACT/ADVANTAGES; COMMUNITY OUTREACH; PROJECT DEVELOPMENT; ENVIRONMENTAL FACTORS/ADVANTAGES OF PROJECT:  This project is the second of five interrelated construction projects that are necessary to bring the Plant into compliance with Ohio EPA regulations, improve operational reliability and increase Plant capacity.
 
Future contracts associated with these Dublin Road Water Plant Improvements are:
· Contract 3, Ozone and Recarbonation Facilities,  Estimate: $40,000,000.00
· Contract 4, Ion Exchange and Plant Reliability Upgrades, Estimate: $100,000,000.00
· Contract 5, DRWP Capacity Increase New Sludge Line, Estimate: $14,500,000.00
 
*Contract 1, Sludge Pump and Electrical Substation, was legislated against Ord#0052-2013, $22,001,320.00 with Kokosing Construction Co., Inc.
 
3. CONSTRUCTION CONTRACT AWARD:  The Director of Public Utilities publicly opened six bids on January 23, 2013 from: Kokosing Construction Co. - $32,430,000.00; Shook/Walbridge Joint Venture - $33,039,500.00; Kenmore Construction Co. - $33,489,150.00; Danis Industrial Construction - $34,413,750.00; Building Crafts, Inc. - $35,731,188.85; and Adams Robinson Enterprises - $37,010,450.00.
 
The lowest, best, most responsive, responsible bid was from Kokosing Construction Co., Inc. in the amount of $32,430,000.00.  Their Contract Compliance Number is 31-1023518 (expires 2/14/14, Majority).  Additional information regarding each bidder, description of work, contract time frame and detailed amounts can be found on the attached Information form.
 
Searches in the Excluded Party List System (Federal) and the Findings for Recovery list (State) produced no findings against Kokosing Construction Co., Inc.
4.  EMERGENCY DESIGNATION: So that there are not any interruptions in the scheduled timeline of the project, this ordinance is being requested as an emergency. The project is the second of five sequential construction projects that are necessary to bring the plant into compliance with Ohio EPA regulations to improve operational reliability and increase plant capacity.
 
5. FISCAL IMPACT:  Funds for this expenditure are included within the Water Works Enlargement Voted Bonds Fund.

WHEREAS, six bids for the Dublin Road Water Plant Treatment Capacity Increase Filter Building Rehabilitation / I & C Backbone Project were received and publicly opened in the offices of the Director of Public Utilities on January 23, 2013; and
 
WHEREAS, Kokosing Construction Co., Inc. was deemed the lowest, best, most responsive, and responsible bidder, in the amount of $32,430,000.00; and
 
WHEREAS, it is necessary to authorize the Director of the Department of Public Utilities to award and execute a construction contract for the Dublin Road Water Plant Treatment Capacity Increase Filter Building Rehabilitation / I & C Backbone Project to Kokosing Construction Co., Inc.; and
 
WHEREAS, it is necessary for this Council to authorize an expenditure of funds within the Water Works Enlargement Voted Bonds Fund, for the Division of Water; and  
 
WHEREAS, an emergency exists in the usual daily operation of the Division of Water, Department of Public Utilities, in that it is immediately necessary to authorize the Director of Public Utilities to enter into a construction contract with Kokosing Construction Co., Inc., for the Dublin Road Water Plant Treatment Capacity Increase Filter Building Rehabilitation / I & C Backbone Project, in an emergency manner as this project is the second of five sequential construction projects that are necessary to bring the plant into compliance with Ohio EPA regulations to improve operational reliability and increase plant capacity, for the immediate preservation of the public health, peace, property and safety; now therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Director of Public Utilities be and hereby is authorized to award and execute a construction contract for the Dublin Road Water Plant Treatment Capacity Increase Filter Building Rehabilitation / I & C Backbone Project with the lowest, best, most responsive, and responsible bidder, Kokosing Construction Co., Inc., 6235 Westerville Road, Suite 200, Westerville, Ohio 43081; in the amount of $32,430,000.00; in accordance with the terms and conditions of the contract on file in the Office of the Division of Water.
 
SECTION 2.  That an expenditure up to $32,430,000.00 is hereby authorized for the Dublin Road Water Plant Treatment Capacity Increase Filter Building Rehabilitation / I & C Backbone Project within the Water Works Enlargement Voted Bonds Fund, Fund No. 606, Division 60-09, Project No. 690428-100003 (New Funding), OCA Code 664283, Object Level Three 6623.
 
SECTION 3.  That said construction company shall conduct the work to the satisfaction of the Director of Public Utilities and the Administrator of the Division of Water.
 
SECTION 4.  That the funds necessary to carry out the purpose of this Ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.
SECTION 5.  That the City Auditor is hereby authorized and directed to transfer any unencumbered balance in the project account to the unallocated balance within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies no longer required for said project; except that no transfer shall be made from a project account by monies from more than one source.
SECTION 6.  That the City Auditor is authorized to establish proper project accounting numbers as appropriate.
SECTION 7.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this Ordinance.
 
SECTION 8.  That for reasons stated in the preamble hereto, which is hereby made a part hereof, this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
