Explanation

1.  BACKGROUND

This ordinance authorizes the Director of the Department Public Service to close out the G591410 (Main Street at McNaughten Road 97197) grant from the Ohio Department of Transportation (ODOT) for the Intersection Improvements - Main Street at McNaughten Road PID 97197 project.

 

Ordinance 1393-2014 authorized the Director of the Department of Public Service to accept the Main Street at McNaughten Road grant and execute a grant agreement with the Ohio Department of Transportation and to enter into contract with Korda/Nemeth Engineering, Inc. for the Intersection Improvements - Main Street at McNaughten Road project. 

Ordinance 3009-2016 authorized the City Attorney's Office, Real Estate Division to hire professional services and to negotiate with property owners to acquire the various property rights necessary to complete the Intersection Improvements-Main Street at McNaughton Road project.

Ordinance 1950-2018 authorized the Director of the Department of Public Service to modify a professional services contract with Korda/Nemeth Engineering to add additional funds for design of the Intersection Improvements - Main Street at McNaughten Road project.

Ordinance 0923-2019 authorized the Director of the Department of Public Service to enter into contract with Shelly & Sands, Inc., for the Intersection Improvements - Main Street at McNaughten Road project and to provide payment for construction, construction administration and inspection services. 

When completing the grant reconciliation for G591410 Main Street at McNaughten Road 97197, it was determined the grant was under charged for eligible expenses in both design and right of way costs.  This ordinance allows the Director of the Department of Public Service to move expenses into grant number G591410 Main Street at McNaughten Road 97197 in order to complete final accounting and close the grant out.  The total amount of grant funding from ODOT is $1,932,982.14, of which $111,213.64 needs to be appropriated.

 

2.  FISCAL IMPACT

Funds in the amount of $158,821.46 are available in Fund 7765, the Federal Transportation Grants Fund in G591410 (Main Street at McNaughten Road 97197) to expenditure correct to Fund 7704, the Streets and Highways Bond Fund, P530086-100029 (Intersection Improvements - Main Street at McNaughten Road). Funds in the amount of $111,213.64 need to be appropriated.

To authorize the City Auditor to appropriate funds within the Federal Transportation Grants Fund; to authorize the City Auditor to expenditure correct funds in the Federal Transportation Grants Fund in connection with the Intersection Improvements - Main Street at McNaughten Road project. ($158,821.46)

 

Body

WHEREAS, the Department of Public Service completed the Intersection Improvements - Main Street at McNaughten Road project; and

 

WHEREAS, Federal Transportation Grant Funds were used to pay for a portion of this project; and

 

WHEREAS, there is a remaining cash balance in the Federal Transportation Grants Fund; and

 

WHEREAS, funds in the amount of $111,213.64 must be appropriated within the Federal Transportation Grants Fund, Fund 7765; and

 

WHEREAS, it is necessary to authorize an expenditure correction between the Federal Transportation Grant Fund, Fund 7765 and Streets and Highways Bond Fund, Fund 7704; and

 

WHEREAS, expenses must be moved from the Intersection Improvements - Main Street at McNaughten Road project to the Main Street at McNaughten Road 97197 project; and

 

WHEREAS, it has become necessary in the usual daily operation of the Department of Public Service to authorize the City Auditor to appropriate funds within the Transportation Grants Fund; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That from the unappropriated monies and from all monies estimated to come into said fund from any and all sources and unappropriated for any other purpose during the fiscal year ended December 31, 2023, the sum of $111,213.64 is appropriated in Fund 7765 (Federal Transportation Grants Fund), Dept-Div 5912 (Design and Construction), Project G591410 (Main Street at McNaughten Road 97197) in Object Class 06 (Capital Outlay) per the account codes in the attachment to this ordinance.

 

SECTION 2.  That the City Auditor be and is hereby authorized to expenditure correct $158,821.46 or so much thereof as may be needed, from Fund 7765 (Federal Transportation Grants Fund), Dept-Div 5912 (Design and Construction), Project G591410 (Main Street at McNaughten Road 97197), Object Class 06 (Capital Outlay) to Fund 7704 (Streets and Highways Bond Fund), Dept-Div 5912 (Design and Construction), Project P530086-100029 (Intersection Improvements - Main Street at McNaughten Road), Object Class 06 (Capital Outlay) per the account codes in the attachment to this ordinance.

 

SECTION 3.  That funds are hereby deemed appropriated and expenditures and transfers authorized to carry out the purposes of this ordinance and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 4.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

SECTION 5.  That the City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project.

 

SECTION 6.  That this ordinance shall take effect and be in force from and after the earliest period by law.
