Explanation
BACKGROUND: This legislation authorizes the Finance and Management Director to enter into a contract on behalf of the Office of Construction Management with Columbus Asphalt Paving, Inc. for the renovation of the pavement for Fire Station No. 8, 1240 East Long Street and Fire Station No. 32, 3675 Gender Road. The pavement is in a state of disrepair and has deteriorated beyond its useful life.
Formal bids were solicited and five companies submitted bids on March 31, 2011 as follows (0 MBE, 0 FBE):

Chemcote, Inc. $313,795.00
WB Republic Builders, LLC. $320,050.00
Decker Construction Company $349,228.00
Heiberger Paving, Inc. $388,923.00
The Office of Construction Management recommends the bid award be made to the most responsive and responsible bidder, Columbus Asphalt Paving, Inc.
Emergency action is requested so that needed renovations can be completed during the upcoming construction season.

Fiscal Impact: This legislation authorizes the expenditure of $289,095.00 from the Department of Public Safety's Gov'l B.A.B.'s (Build America Bonds) Fund.

WHEREAS, it is necessary to renovate the pavement for Fire Station No. 8, 1240 East Long Street and Fire Station No. 32, 3675 Gender Road; and
WHEREAS, bids were solicited and the Columbus Asphalt Paving, Inc. is the most responsive, responsible and best bidder for said renovations; and
WHEREAS, an emergency exists in the usual daily operation of the Finance and Management Department, Office of Construction Management, in that it is immediately necessary to authorize the Finance and Management Director to enter into a contract with Columbus Asphalt, Inc. for the renovation of the pavement for Fire Station No. 8, 1240 East Long Street and Fire Station No. 32, 3675 Gender Road, so the renovations are completed as soon as possible during the upcoming construction season, thereby providing the necessary services to City residents preserving the public health, peace, property, safety, and welfare, now, therefore:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECT ION 1. That the Finance and Management Director is hereby authorized to enter into a contract on behalf of the Office of Construction Management with Columbus Asphalt, Inc. for the renovation of the pavement for Fire Station No. 8, 1240 East Long Street and Fire Station No. 32, 3675 Gender Road.
SECTION 2. That the expenditure of $289,095.00, or so much thereof as may be necessary in regard to the action authorized in SECTION 1, be and is hereby authorized and approved as follows:

SECTION 3.
