Explanation
1. Background
The City of Columbus, Department of Public Service, received a request from the E.P. Ferris & Associates, Inc. on behalf of the owner Lane and Norwich Columbus Owner, LLC, asking that the City allow a step to encroach into the public right-of-way on Lane Avenue. This project is located at 222 West Lane Avenue. This project is a new mixed-use building on Lane Avenue that will be replacing the Harrison House building. This encroachment is located along the north side of Lane Avenue and the easement is described below and within the attached exhibit.
The following legislation authorizes the Director of the Department of Public Service to execute those documents necessary for the City to grant this encroachment and legally allow the step to extend into the public rights-of-way. Allowing this element to extend into the public right-of-way will allow for the compliance of the approved building plan and fit into the architectural design. A value of $500.00 for the encroachment easement was established.
2. Fiscal Impact
The City will receive a total of $500.00, to be deposited in Fund 7748, Project P537650, for granting the requested encroachment.

WHEREAS, the City of Columbus, Department of Public Service, received a request from E.P. Ferris & Associates, Inc. on behalf of the owner Lane and Norwich Columbus Owner, LLC, asking that the City allow a step to encroach into the public right-of-way. This encroachment consisting of a step that extends into Lane Avenue right-of-way. This project is located at 222 West Lane Avenue; and
WHEREAS, this project is a new mixed-use building on Lane Avenue that will be replacing the Harrison House building. This encroachment is located along the north side of Lane Avenue and the easement is described below and within the attached exhibit; and
WHEREAS, a value of $500.00 was established for the encroachment easement to be deposited into fund 7748, Project P537650; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the Director of the Department of Public Service hereby authorized to execute those documents necessary for the City to grant this encroachment and legally allow it to extend into the public rights-of-way site owner, Lane and Norwich Columbus Owner, LLC, and attached exhibits; to-wit:

Situated in the State of Ohio, County of Franklin, in the City of Columbus, and being in Quarter Township 3, Township 1, Range 18, United States Military Lands, being part of Lots 13 and 14 of R.P. Woodruff’s Subdivision of the East End of Lot No. 26 of Sidney L Chaffee’s Northwood Place, of record in Plat Book 2, Page 284, being part of a 0.086 acre tract as conveyed to the City of Columbus, Ohio in Instrument Number 202210070141858, being within the right-of-way of Lane Avenue (varies), all records being of the Recorder’s Office, Franklin County, Ohio, and being more particularly described as follows: This description has a vertical component. The intent of this description is to include an area from an elevation 1 foot below the bottom of a concrete sidewalk up to an elevation 1 foot above the concrete sidewalk. The bottom of the area is 740.54 feet (NAVD88) and the top is 744.27 feet (NAVD 88). The elevations given go along with the horizontal metes and bounds described below, creating an extruded block of air-space.
COMMENCING at the northwesterly corner of said 0.086 acre tract, being on the northerly right-of-way line of said Lane Avenue; Thence along the northerly line of said 0.086 acre tract and said Lane Avenue, along a curve to the left having a radius of 5679.58 feet, a delta angle of 00°40’45”, an arc length of 67.31 feet, and a chord bearing and distance of South 86°47’04” East, 67.31 feet to a point, said point being the TRUE POINT OF BEGINNING: Thence continuing along the northerly line of said 0.086 acre tract and said Lane Avenue, along a curve to the left having a radius of 5679.58 feet, a delta angle of 00°30’34”, an arc length of 50.50 feet, and a chord bearing and distance of South 87°22’43” East, 50.50 feet to a point, being from elevation 740.54 (NAVD 88) to 744.27 (NAVD88); Thence leaving said northerly lines and across said 0.086 acre tract and the right-of-way of said Lane Avenue, the following three (3) courses:

Subject however to all legal easements and restrictions of record in the respective utility offices.
The bearings referenced herein are based on the Ohio State Plan Coordinate System, South Zone, NAD83 (2011) being the southerly line of Norwich Avenue, bearing South 86°11’07” East. The bearing originated from a field traverse which was referenced to said coordinate system by GPS observations and observations of selected station in the Ohio Department of Transportation Virtual Reference Station Network. The elevations are based on the North American Vertical Datum of 1988 (NAVD 88, Geoid 12A). Elevations were established using GPS observations of select control points utilizing the Ohio Department of Transportation’s Virtual Reference Station and transferred to the site via bench circuit. All other elevations were calculated from proposed dimension and the established elevations from local benchmarks. This description was prepared on April 14, 2025 by Matthew Lee Sloat, Ohio Registered Professional Surveyor 8342, of E.P. Ferris and Associates, Inc. based on field work from February 2020 through June 2020.
Section 2. That the City Attorney is required to approve all instrument(s) associated with this ordinance prior to the director of the Department of Public Service executing and acknowledging any of those instrument(s).
SECTION 3. That the City will receive a total of $500.00 for granting the encroachment easement, to be deposited into Fund 7748, Project P537650.
SECTION 4. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
