Explanation

BACKGROUND

This ordinance authorizes the Director of the Department of Development to modify a grant agreement with Oregon Corporation for Affordable Housing for the Reserve at Maryland development to adjust the project’s budget funded line items.  The overall amount of the agreement will not change.

Ordinance no. 2327-2025, approved by Columbus City Council on September 8, 2025 authorized the Director of Development to enter into a grant agreement in an amount up to $2,020,000.00 with Oregon Corporation for Affordable Housing, and they subsequently assigned the agreement to Reserve at Maryland Ave, LLC for the Reserve at Maryland rental development project. 

 

The grant agreement for the project in an amount up to $2,020,000.00 was established under purchase order PO529934.  Within the agreement a budget was established with line item costs that the City of Columbus would reimburse to the project.  The developer has since had a need to request a budget modification to move funding from the “Purchase of Land and Buildings” to “New Construction” costs.  All other aspects of the agreement and budget will remain. 

 

EMERGENCY DESIGNATION:  Emergency action is needed to meet the projects timeline and to not delay the progress already made in construction.  Without emergency action, this new affordable housing project would be further delayed for a population that is in urgent need of it. 

 

FISCAL IMPACT: No additional funding is required but this legislation is also contingent upon the vendor obtaining an active Ohio Secretary of State Registration as it expired 02/21/2026.

 

CONTRACT COMPLIANCE: The vendor number is 053446 and expires 08/25/2027.

Body

WHEREAS, Ordinance no. 2327-2025, approved by Columbus City Council on September 8, 2025 authorized the Director of Development to enter into a grant agreement funded in an amount up to $2,020,000.00 in Affordable Housing Bond funds with Oregon Corporation for Affordable Housing, and they subsequently assigned the agreement to Reserve at Maryland Ave, LLC for the Reserve at Maryland rental development project; and

 

WHEREAS, it is necessary to authorize the modification of the grant agreement to revise the budget within the grant agreement that was established under Purchase Order PO529934; and

 

WHEREAS, the budget revision will move funding from the “Purchase of Land and Buildings” to “New Construction” costs line item within the projects budget only, all other aspects of the grant agreement and budget will remain the same.  This budget modification is contingent upon the vendor obtaining an active Ohio Secretary of State Registration; and

 

WHEREAS, an emergency exists in the usual daily operation of the Department of Development in that it is immediately necessary to authorize the Director of the Department of Development to modify the grant agreement with Oregon Corporation for Affordable Housing to revise the funding from the “Purchase of Land and Buildings” to “New Construction” costs line item within the projects budget in order to meet the projects timeline and to not delay the progress already made in construction thereby preserving the public health, peace, property, safety and welfare; and NOW THEREFORE

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the Director of the Department of Development be and is hereby authorized to modify a grant agreement with Oregon Corporation for Affordable Housing for the Reserve at Maryland development to adjust the project’s budget funded line items from the “Purchase of Land and Buildings” to “New Construction” costs line item.  All other aspects of the grant agreement and budget remain the same.  This is contingent upon the vendor obtaining an active Ohio Secretary of State Registration. 

 

SECTION 2.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this Ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
