Explanation
BACKGROUND: The Purchasing Office received and opened bid number SA001815 for six hydraulic power units, for the Division of Water on November 10, 2005. These hydraulic power units will be used to provide power to operate valve turning machines, hydraulic hammers and other hydraulic tools in the field. The Division of Water budgeted $31,200.00 for this purchase. Four bids were received. The lowest responsive, responsible and best bid was E.H. Wachs Company at $35,820.00. The Purchasing Office mailed bids to all registered vendors under this commodity. The contract compliance number for E.H. Wachs Company is 36-1920320. They do not have MBE/FBE status. Of the 61 vendors solicited, one company holds FBE status.
It is requested that this Ordinance be handled in an emergency manner, as this item was only budgeted for 2005 and current equipment is no longer operative and too costly to repair.
Fiscal Impact: The Division of Water budgeted $31,200.00 for this purchase. Expenditures under Object Level One 06 will be re-prioritized in order to cover the deficit. There have been no expenditures for hydraulic power units in the last two years.

WHEREAS, the Purchasing Office did receive and open bid number SA001815 for the purchase of six hydraulic power units on November 10, 2005, and
WHEREAS, four bids were received by the Purchasing Office, and
WHEREAS, E.H. Wachs Company met or exceeded all of our specifications, therefore, we are recommending award of this contract go to E.H. Wachs Company as the lowest responsive, responsible, and best bidder to meet specifications, and
WHEREAS, an emergency exists in the usual daily operation of the Division of Water, Department of Public Utilities, in that it is immediately necessary to authorize the Director of Finance and Management to enter into a contract with E.H. Wachs Company, for hydraulic power units, needed by the Distribution activity, in an emergency manner, as this item was only budgeted for 2005 and current equipment is no longer operative and too costly to repair, for the immediate preservation of public health, peace, property and safety; now, therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the Director of Finance and Management be and is hereby authorized to enter into a contract with E.H. Wachs Company, as the lowest responsive, responsible, and best bidder, for six hydraulic power units, for the Division of Water, Department of Public Utilities.
Section 2. That the expenditure of $35,820.00 or as much thereof as may be needed, is hereby authorized from Water Works Fund 600, Department 60-09, Object Level One 06, OCA 602730, Object Level Three 6651, to pay the cost thereof.
Section 3. That for the reasons stated in the preamble hereto which is hereby made a part hereof, this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
