Rezoning Application Z24-024

 

APPLICANT:  Tijen Incorporated, LLC; c/o Dave Perry, Agent; David Perry Company, Inc.; 411 East Town Street, First Floor; Columbus, OH 43215, and Donald Plank, Atty.; 411 East Town Street, Second Floor; Columbus, OH 43215.

 

PROPOSED USE:  Multi-unit residential development.

 

DEVELOPMENT COMMISSION RECOMMENDATION:  Approval (5-1) on January 9, 2025.

 

GREATER SOUTH EAST AREA COMMISSION RECOMMENDATION:  Disapproval.

 

CITY DEPARTMENTS' RECOMMENDATION:  Approval.  The 0.92± acre site consists of one undeveloped parcel in the C-4, Commercial District. The applicant requests the L-AR-1, Limited Apartment Residential District to allow for a 20-unit apartment building. The limitation text includes commitments to a maximum of 20 apartment units, building height, building setback, parking setbacks, site access, landscaping, and building materials, and includes a commitment to develop the site in accordance with the submitted site plan.  The South East Land Use Plan (2018) recommends “Mixed Use 1 (<24 du/acre)” land uses at this location, which includes a density recommendation of not more than 24 dwelling units per acre. The proposed development is consistent with the Plan’s recommended land use and density, and the committed site plan is consistent with Columbus Citywide Planning Policies (C2P2) Design Guidelines (2018). The proposal also meets the City’s objective of creating more housing in all areas of the city. A concurrent Council Variance (Ordinance #1980-2025; CV24-075) is included with this project, and includes variances to reduce the required parking lot landscaping and parking setback line.

WHEREAS, application #Z24-024 is on file with the Department of Building and Zoning Services requesting rezoning of 0.92± acres from C-4, Commercial District, to L-AR-1, Apartment Residential District; and

 

WHEREAS, the Development Commission recommends approval of said zoning change; and

 

WHEREAS, the Greater South East Area Commission recommends disapproval of said zoning change; and

 

WHEREAS, the City Departments recommend approval of said zoning change because the requested L-AR-1, Limited Apartment Residential District will allow a 20-unit apartment building that is consistent with the South East Land Use Plan’s land use and density recommendations. The proposal is also consistent with C2P2 Design Guidelines and meets the City’s objective of creating more housing in all areas of the city; now, therefore:  

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the Official Zoning Map of the City of Columbus, as adopted by Ordinance No. 0179 -03, passed February 24, 2003, and as subsequently amended, is hereby revised by changing the zoning of the property as follows:

All that certain piece, parcel, or tract of land, situate, lying and being in Franklin County, Ohio, more particularly described as follows:

 

Situated in Section 27, Township 12 North, Range 21 West, Refugee Tract, in the City of Columbus, County of Franklin, State of Ohio, and being 0.918 acre of land out of Reserve "E' of Walnut Bluff No.2, as the said reserve is lettered and delineated upon the recorded plat thereof, of record in Plat Book 34, Pages 110, 111, and 112, Recorder’s Office, Franklin County, Ohio, and bounded and described as follows:

 

Beginning at an iron pin at the intersection of the northeast line of Lindora Drive (60 feet wide) with the southeast line of Carbondale Drive (60 feet wide), said iron pin also being at the most westerly corner of said Reserve "E";

 

Thence N 49° 41' 30" E along the southeast line of Carbondale Drive and a portion of the northwest line of said Reserve "E" a distance of 200.00 feet to an iron pin;

INTRODUCTION: The undeveloped site, PID: 010-002548, is 0.92 +/- acres located at the northeast corner of Lindora Drive and Carbondale Drive, is zoned C-4, Commercial. Applicant proposes to rezone the property to the L-AR-1, Limited Apartment Residential District to build a 20-dwelling unit apartment building, two (2) story apartment building. The site plan titled “Lindora Apartments Zoning Site Plan”, dated 06/20/2025, hereafter “Site Plan”, is submitted to depict the proposed site development. See also CV24-075.

 

1. PERMITTED USE: The permitted use shall be a single 20-dwelling unit apartment building and accessory uses to an apartment building, as permitted by Chapter 3333, Apartment Districts, Section 3333.02, AR-1, Apartment Residential District Use. 

 

2. DEVELOPMENT STANDARDS: Unless otherwise indicated on the Site Plan or in this written text, the applicable development standards shall be those standards contained in Chapter 3333, Apartment Districts, Chapter 3312, Off-Street Parking and Loading and Chapter 3321, General Site Development Standards, of the Columbus City Code. as applicable to the AR-1 Apartment Residential District and as depicted on the Site Plan.

 

A. Density, Height, Lot, and/or Setback Commitments:

1. A maximum of 20 dwelling units shall be permitted.

2. The apartment building shall be a maximum of two (2) stories, shall have a pitched roof and shall be approximately 27’ (+/-) to the mid-point of the roof.

3. The minimum Lindora Drive and Carbondale Drive building setbacks shall be 25’.  

4. The minimum Lindora Drive and Carbondale Drive parking setbacks shall be 12’ and 25’, respectively, as depicted on the Site Plan. See CV24-075.

5. The north and east building and pavement setback shall be a minimum of 10’, including a minimum 10’ setback for the refuse area.

B. Access, Loading, Parking and/or other Traffic Related Commitments:

One (1) full turning movement driveway for vehicular access to the site shall be permitted on Lindora Drive, as depicted on the Site Plan. There shall be no vehicular access to Carbondale Drive. Existing driveways on Lindora Drive and Carbondale Drive shall be closed.

C. Buffering, Landscaping, Open Space, and/or Screening Commitments:

1. Five (5) trees shall be provided along each of the Carbondale Drive and Lindora Drive frontages, as depicted on the Site Plan.

2. Parking lot screening (5’, 75% opacity) shall be provided with a fence along the north and east property lines, as depicted on the Site Plan. The fence shall be increased to 6’ tall where adjacent to the refuse area.

3. Landscaping consisting of 18 trees (street and/or ornamental trees) at 20’ on-center +/-, shall be planted in the north and east setbacks, as depicted on the Site Plan.

D. Building Design and/or Exterior Treatment Commitments:

The primary exterior building materials shall be vinyl siding and brick, including brick veneer. 

E. Lighting and/or other Environmental Commitments:

N/A

F. Graphics and Signage Commitments.

 

All graphics shall conform to Article 15 of the Columbus Graphics Code, as it applies to the AR-1, Apartment Residential District. Any variance to applicable sign requirements shall be submitted to the Columbus Graphics Commission.

 

G. Miscellaneous Commitments.

 

1. The site shall be developed in accordance with the submitted Site Plan titled “Lindora Apartments Zoning Site Plan”, dated 06/20/2025, submitted to depict the proposed site development, signed by David B. Perry, Agent for Applicant and Donald Plank, Attorney for Applicant. See also CV24-075. The referenced plans may be slightly adjusted to reflect engineering, topographical, architectural or other site and/or building data developed at the time final development, engineering plans and architectural plans are completed.

 

2. Applicant shall comply as applicable with the Parkland Dedication Ordinance (PDO) in conjunction with the Final Site Compliance Plan. 

 

3. Refuse service and bulk pickup shall be provided by the City of Columbus. 

 

SECTION 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
