Explanation
BACKGROUND:
This ordinance approves the acceptance of certain territory (AN26-005) by the city of Columbus. The Ohio Revised Code stipulates that to be effective, City acceptance must take place a minimum of 60 days from the receipt by the City Clerk of the approval notice from the county. If City Council does not accept the ordinance within 120 days of its first consideration, the annexation will be considered rejected. This petition was filed with Franklin County on April 8, 2026. City Council approved a service ordinance addressing the site on April 27, 2026. Franklin County approved the annexation on May 19, 2026 and the City Clerk received notice on June 5, 2026.
FISCAL IMPACT:
Provision of municipal services does represent cost to the City; however, the annexation of land also has the potential to create revenue to the City.

WHEREAS, a petition for the annexation of certain territory in Madison Township was filed on behalf of Wildermuth Family Revocable Living Trust on April 8, 2026; and
WHEREAS, the petition was considered and approved by the Franklin County Board of Commissioners at a hearing on May 19, 2026; and
WHEREAS, on June 5, 2026, the City Clerk received from Franklin County a certified copy of the resolution addressing the petition; and
WHEREAS, sixty days have now elapsed since receipt of the resolution in accordance with the provisions of the Ohio Revised Code; and
WHEREAS, it is in the best interest of the city of Columbus to accept the annexation of the territory addressed by the petition; now, therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS
SECTION 1. That the annexation proposed by Wildermuth Family Revocable Living Trust in a petition filed with the Franklin County Board of Commissioners on April 8, 2026 and subsequently approved by the Board on May 19, 2026 is hereby accepted and said territory is hereby annexed to the city of Columbus. Said territory is described as follows:
Situated in the State of Ohio, County of Franklin, Township of Madison, part of Section 14, Township 11, Range 21 of Congress Lands East of Scioto River, containing 167.2± acres more or less, said 167.2± acres being part of a tract of land referred to as Tract One, First Parcel, part of a tract of land referred to as Tract Five, and part of a tract of land referred to as Tract One, Second Parcel, all conveyed to Jerry Wildermuth & Gina Wildermuth, Co-Trustees of the Wildermuth Family Revocable Living Trust in I.N. 201810220143701, part of a 1.5327 acre tract of land conveyed to Russell C. Flagg and Erica Gingerich in l.N. 200206240154755, part of a 2.608 acre tract of land conveyed to the City of Columbus, Ohio in l.N. 202412060128217, part of a 0.648 acre tract of land conveyed to the City of Columbus, Ohio in I.N. 1998082702 17702, and more particularly described as follows:
Beginning for reference at the centerline intersection of Winchester Pike (R/W Varies) and Bachman Road (R/W Varies), the southeasterly corner of a 6.326 acre tract of land conveyed to Franklin County Commissioners in I.N. 202504180039733 as Parcel 1-WD, the southwest comer of said Tract One, First Parcel, and the northwest corner of said Tract One, Second Parcel;

Thence N 86° 16' 35" W, with the north line of said 1.104 acre tract, across said Tract Five, the south line of said 2.608 acre tract, passing the common line of said Section 14 and 13, and across the right-of-way of said Brice Road (R/W Varies), 60.4± feet to a point on the westerly right-of-way line of said Brice Road (R/W Varies);
Thence S 03° 53' 42" W, across said Tract Five and along the westerly right-of-way line of said Brice Road (R/W Varies), 437.6± feet to an angle point of said Tract Five and the north line of a 1.056 acre tract of land conveyed to Rickenbacker Port Authority in O.R. 18450B06;

Thence N 85° 32' 50" W, across the right-of-way of said Brice Road (R/W Varies), with the north line of said 1.359 acre tract, the south line of said Tract Five and said Tract One, First Parcel, the north line of an original 82.9675 acre tract of land conveyed to Harriet S.B. Levin in O.R. 12425H13 as Parcel 11, and with said northerly existing City of Columbus Corporation Line (Case No. 24-22, Ord. Thence N 85° 32' 50" W, with the north line of said 1.197 acre tract and the south line of said Tract One, First Parcel, 163.2± feet to the northwest comer of said 1.197 acre tract and the northeast comer of said Tract One, Second Parcel;
Thence S 03° 11' 52" W, with the west line of said 1.197 acre tract and the east line of said Tract One, Second Parcel, 217 .5± feet to the northerly right-of-way line of said Winchester Pike (R/W Varies);
Thence N 40° 04' 33" W, with the northerly right-of-way line of Winchester Pike (R/W Varies) and across said Tract One, Second Parcel and Tract One, First Parcel, 360.7± feet to the Point of Beginning, containing 167.2± acres, more or less.
The above description was prepared by Advanced Civil Design, Inc. on February 3, 2026 and is based on existing records obtained from the Franklin County Auditor's and Recorder's Office.
The total length of the annexation perimeter is ± 11,655 feet, of which ±9,710 feet are contiguous with existing City of Columbus Corporation lines, being ±83% contiguous.

SECTION 2. That the City Clerk is hereby authorized and directed to make three copies of this ordinance to each of which shall be attached a copy of the map accompanying the petition for annexation, a copy of the transcript of proceedings of the Board of County Commissioners relating thereto, and a certificate as to the correctness thereof, the City Clerk shall then forthwith deliver one copy to the County Auditor, one copy to the Board of Elections thereof and do such other things as may be required by law.
SECTION 3. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
