Explanation
1. BACKGROUND:
A. Need. This legislation authorizes the Director of Public Utilities to enter into a planned modification of the professional engineering services agreement with DLZ Ohio, Inc. for the Alum Creek Sanitary Sewer Relief Tunnel (ART), for the Division of Sewerage and Drainage.
This contract modification will fund detailed design efforts required for this project. These activities will include continuation of the soil boring program; a continuation of the sewer modeling efforts; preparation of construction drawings including civil, tunnel, site, structural, and instrumentation plans; preparation of bidding documents and specifications; and value engineering for the project. The contractor, DLZ Ohio, Inc., has requested a modification amount of $5,300,316.24 under this ordinance. The contract total including this modification is $7,294,154.98. There is an expected future modification (#2) of $4,500,000.00 scheduled to take place in 2011 at this time. The contract total after this second modification would reflect a grand total of $11,794,154.98.
The Division has determined that these services cannot be performed by City personnel at this time, and has planned for the procurement of these servicesin the project scope of services. The work under this contract modification is a planned update to be done as part of the final plan preparation. The cost of the modification is a continuation of the vendor's current pricing structure, as verified by City staff. This legislation will additionally authorize the expenditure of funds within the Sanitary Sewer Bond Fund.

2. FISCAL IMPACT:
A transfer of cash and budget authority is not necessary in this ordinance as the project already has sufficient funding and authority in the 2007 Capital Improvements Budget.
3. PROJECT LOCATION:
The Alum Creek Sanitary Sewer Relief Tunnel (ART) will be constructed in three phases, A, B and C. Phase A will extend ART from BWARI termination point at the Big Walnut Outfall to a location near the intersection of Integrity Drive and Alum Creek Drive. The length of Phase A is approximately 27,000 ft. This location represents the first major relief point of the existing Alum Creek Trunk (ACT) Sewer. Phases B (~ 20,000 ft) and C (~25,000 ft.) will continue ART to Morse Road.

WHEREAS, Contract No. EL006426 was authorized by Ordinance No. 0217-2005, as passed by Columbus City Council on February 28, 2005 for purposes of authorizing the Director of Public Utilities to enter into a contract for professional engineering services with DLZ Ohio, Inc., for the Alum Creek Sanitary Sewer Relief Tunnel; and
WHEREAS, the Division of Sewerage and Drainage engineering personnel have determined that it is necessary to enter into a planned modification of the subject contract in order to provide the necessary additional engineering services required for this project; and
WHEREAS, the Division of Sewerage and Drainage, Department of Public Utilities is requesting that this Council authorize the Director of Public Utilities to enter into a planned modification of the professional engineering services agreement with DLZ Ohio, Inc., for the Alum Creek Sanitary Sewer Relief Tunnel, at the earliest practical date; Now, Therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the Director of Public Utilities be, and hereby is, authorized to modify Contract No. EL006426 with DLZ Ohio, Inc., 6161 Huntley Road, Columbus, Ohio 43229-1003, for the Alum Creek Sanitary Sewer Relief Tunnel, in order to provide for additional professional engineering services in accordance with the terms and conditions as shown in the contract modification on file in the office of the Division of Sewerage and Drainage.
Section 2. That for the purpose of paying the cost of the professional engineering services contract modification, the following expenditure, or as much thereof as may be needed, be and the same is hereby authorized as follows: Division 60-05; Fund 664; Alum Creek Sanitary Sewer Relief Tunnel, Project No. 650046; Object Level3 6676; OCA Code 651046; Amount $5,300,316.24.
Section 3. That the City Auditor is hereby authorized to transfer any unencumbered balance in the project account to the unallocated balance within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies no longer required for said project; except that no transfer shall be made from a project by monies from more than one source.
Section 4. That the City Auditor is authorized to establish proper project accounting numbers as appropriate.
Section 5. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
Section 6. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
