Explanation
BACKGROUND: This ordinance authorizes the Director of the Department of Development to amend a contract with YAHS Construction, a Certified Emerging Minority Business Enterprise Company,(cc# 80-0392038, expires July 21, 2011) to provide lawn care service on City owned property being held in the Land Bank and purchased with Neighborhood Stabilization Program Funds. Legislation was approved on June 7, 2010 (0754-2010) to authorize the use of $195,000 of the Neighborhood Stabilization Funds for lawn care services through March 4, 2013 and to establish two, one-year contract extension periods. This legislation will amend the contract to authorize the expenditure of $20,000 from the Second Neighborhood Stabilization Fund to permit the maintenance of properties acquired under NSP 2, and to extend the term through the first contract extension period, until December 31, 2011.
Emergency action is requested to avoid interruptions in the delivery in program services.
FISCAL IMPACT: The $20,000 for this contract will come from the General Government Grant Fund. This legislation will authorize the Director of the Development Department to amend an existing contract for lawn care services on property acquired through NSP 1 and 2. Auditor Certificate AC 031459-004 will be reduced by $100,000 and these funds will be transferred to Object Level One 03 to provide funding for NSP property holding costs. The $20,000 needed for this contract increase will come from these cancelled funds.

WHEREAS, this ordinance authorizes the Director of the Department of Development to amend a contract with YAHS Construction Co., to provide lawn care services under the Neighborhood Stabilization Program, and
WHEREAS, an initial contract was established for the amount of $195,000.00 to provide lawn care services under the Neighborhood Stabilization Program through December 31, 2010, with an option to renew the contract twice for additional one year terms; and
WHEREAS, the Department of Development desires to extend the contract through the first contract extension term, until December 31, 2011; and
WHEREAS, the Department of Development desires to increase the maximum obligation of the contract to $215,000.00 to add properties acquired through the Second Neighborhood Stabilization Program; and
WHEREAS, the Department of Development desires to amend the contract to permit servicing of properties acquired under the Second Neighborhood Stabilization Program and to authorize the expenditure of an additional $20,000.00 from the General Grant Fund (NSP 2); and
WHEREAS, YAHS Construction Company was one of two contractors selected that responded to the request for bids (2010 SA003553) and;
WHEREAS, YAHS Construction Company is a Certified Emerging Minority Business Enterprise company with Equal Business Opportunity Commission Office; and
WHEREAS, an emergency exists in the usual daily operation of the Department of Development in that it is immediately necessary to transfer funds and amend said contract to avoid interruptions in the delivery in program services, thereby preserving the public health, peace, property and safety; NOW THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the City Auditor is hereby authorized to cancel $100,000.00 from Auditor Certificate No. AC 031459-004 to provide funding for holding costs related to properties acquired through the Neighborhood Stabilization Program grant.
Section 2. That the City Auditor be and is hereby authorized and directed to transfer $100,000 within the General Government Grant Fund, Fund No.220, Grant Number 451036, Division No. 44-01, OCA Code 441049, as follows:

Section 3. That the Director of the Department of Development is hereby authorized to amend the contract with YAHS Construction Company to provide lawn care services under the Neighborhood Stabilization Programs 1 and 2 and by extending the contract through the first contract extension term, until December 31, 2011 and increasing the maximum obligation to $215,000.00.
Section 4. That for the purpose stated in Section 3, the expenditure of $20,000.00 or so much thereof as may be necessary, be and is hereby authorized to be expended from the Department of Development, General Government Grant Fund, Fund 220, Grant No. 451036, Object Level One 03, Object Level Three 3354, OCA Code 441049.
Section 5. That for reasons stated in the preamble hereto, which is hereby made a part hereof, the ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after the passage if the Mayor neither approves nor vetoes the same.
