Explanation

1.               BACKGROUND

A.                     Need: The Division of Police needs to purchase a digital photography software application through Kwan Software Engineering, Inc The Division of Police will use this software application to authenticate digital photos for presentation in court, interface with the records management system, and allow Division of Police employees to view these digital photos once they are attached to a case folder in the records management system.

B.                     Bid Information: This is a sole source provider. Veripic by Kwan Software Engineering, Inc. holds the patent on this software application. It is the only company that can meet all of the Division of Police requirements for digital photography authentication. The purchase price of the digital photography software application is $45,953.00.

C.                     Contract Compliance No.                     770361972

D.                     Emergency Designation: Emergency legislation is requested because negotiated price is only good for a limited time.

2.                     FISCAL IMPACT:

Since this purchase will be made with funds from the 2003 Local Law Enforcement Block Grant, there will be no immediate effect on the financial status of the General Fund.

To authorize and direct the Finance Director to enter into agreement with Kwan Software Engineering, Inc. for the purchase of the Veripic digital photography software application, in accordance with the sole source procurement for the Division of Police, to authorize the expenditure of $45,953.00 from the  Local Law Enforcement Block Grant Fund; and to declare an emergency. Body

WHEREAS, Veripic by Kwan Software Engineering, Inc. is the sole source to purchase this type of digital photography software application; and

WHEREAS, there is a need to purchase this software application to authenticate digital photos for presentation in court, interface with the records management system, and allow Division of Police employees to view these digital photos once they are attached to a case folder in the records management system; and

WHEREAS, cost for this purchase was negotiated by Kwan Software Engineering and Division of Police personnel; and

WHEREAS, an emergency exists in the daily operation of the Division of Police, Department of Public Safety, in that it in order to purchase this software at the negotiated price it is immediately necessary to enter into contract for the purchase of the Veripic digital photography software application for the immediate preservation of the public peace, health, safety, and welfare; now, therefore

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS

Section 1. That the Finance Director be and is hereby authorized and directed to enter into agreement with Kwan Software Engineering, Inc. for the purchase of a digital photography software application, for the Division of Police.

Section 2. That said agreements shall be awarded in accordance with provisions of Section 329.07©(Sole Source) of the Columbus City Code, 1959.

Section 3. That the expenditure of up to $45,953.00 or so much as thereof as may be needed, be and the same is hereby authorized as follows:

Section 4. That for the reasons stated in the preamble hereto, which is hereby made a part thereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be force from and after is passage approval by the Mayor, or ten days after passage if the Mayor neither approved nor vetoes the same.
