Title: To authorize the Director of the Department of Technology to modify a contract with EMC Corporation for maintenance support services; to authorize the expenditure of $24,399.76 from the Information Services Fund, and to declare an emergency ($24,399.76)
Explanation
BACKGROUND: This legislation authorizes the Director of the Department of Technology (DoT) to modify and extend a contract established by purchase order EL003608, provided by EMC Corporation, for maintenance and support services necessary to protect and ensure system availability and reliability for vital software applications utilized by Police, payroll and Building Services Development (BSD).  This service allows DoT to receive upgrades and new support releases, advanced remote support, on-site maintenance, 24-hour help line service via telephone or electronic device, it supports the One-Stop-Shop Permit System utilized by BSD, and it allows DoT to store all of Police and payroll information associated with mission critical software applications.  
 
It is in the best interest of the city to modify and extend this maintenance agreement that provides a variety of ongoing support, repairs and assistance that is critical to the city's daily operations.  This agreement will cover the period from April 1, 2004 through March 31, 2005.
   
EMERGENCY: There is an immediate need to modify a contract with EMC for maintenance support services to maintain on-going support and to allow for uninterrupted daily operations.
 
FISCAL IMPACT:  In fiscal year 2003, $33,948.84 was expended for a 14-month period through March 31, 2004 for services provided by EMC.  Funding of $33,065.00 is budgeted and available in the 2004 Department of Technology, Information Services Fund budget; however, only $24,399.76 will be needed for the 2004 contract.

Body
WHEREAS, this legislation authorizes the Director of the Department of Technology (DoT) to modify and extend a contract with EMC Corporation established by purchase order EL003608, and
 
WHEREAS, the agreement provides for support of mission critical software applications that are vital to daily operations within the city by providing on-site maintenance, 24-hour help line via telephone or other electronic media, software updates and releases and documentation updates, and
 
WHEREAS, it supports the One-Stop-Shop Permit System utilized by BSD, and it allows DoT to store all of Police and payroll information associated with mission critical software applications, and
 
WHEREAS, this agreement will cover the period from April 1, 2004 through March 31, 2005, and  
 
WHEREAS, an emergency exists in the usual and daily operation of the Department of Technology in that it is immediately necessary to modify a contract with EMC Corporation for support of mission critical software applications, for the preservation of the public health, peace, property, safety and welfare; now, therefore
 
 
                                                                           BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
 
SECTION 1. That the Director of the Department of Technology be and is hereby authorized to modify and extend a contract with EMC Corporation established by purchase order EL003608, for the maintenance support services, utilized by Police, payroll and BSD One-Stop-Shop in the amount of $24,399.74.
 
SECTION 2. That the expenditure of $24,399.74 or so much thereof as may be necessary is hereby authorized to be expended from:

SECTION 3. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
