AN03-032
BACKGROUND:      This ordinance is submitted to present to Council the transcript of proceedings and papers relating to Annexation AN03-032 a certain petition for annexation as described in the ordinance and transcript which is attached hereto. More than sixty days have elapsed since November 24, 2003, the date of receipt from the Board of County Commissioners of Franklin County.
 
These are submitted in accordance with the Ohio Revised Code.
 
FISCAL IMPACT:      Provision of municipal services for a proposed annexation area has no fiscal impact.  However, provision of the stated services does represent cost to the city.  The annexation of land also has the potential to create revenue to the city.
 
 
 
 
Title
 
To accept the application (AN03-032) of Meridian Industrial Trust for the annexation of certain territory containing 5.791 ± Acres in Hamilton & Madison Townships.
 
 
 
 
Body
 
WHEREAS,   a petition for the annexation of certain territory in Hamilton & Madison Townships was duly filed by Meridian Industrial Trust on October 8, 2003; and
 
WHEREAS,  the said petition was duly considered by the Board of County Commissioners of  Franklin County, Ohio, and the annexation of said hereinafter described territory to the city of Columbus was approved by said Commissioners by order dated November 18, 2003; and
WHEREAS,  the Board of County Commissioners of  Franklin County certified the transcript of the proceedings in connection with the said annexation with the map and petition required in connection therewith to the City Clerk who received the same on November 24, 2003; and
WHEREAS,  sixty days from the date of said filing have now elapsed in accordance with the provisions of the Ohio Revised Code; and
 
WHEREAS,  it is in the best interest of the city of Columbus to accept the annexation of the territory sought to be annexed by the aforesaid petition; now, therefore,  
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS
 
Section 1.  That the proposed annexation as applied for in the petition of Meridian Industrial Trust being the majority of owner(s) of real estate in the territory sought to be annexed and filed with the Board of County Commissioners of Franklin County, Ohio October 8, 2003 in which said petition prayed for annexation to the city of Columbus, Ohio, of certain territory adjacent thereto as hereinafter described, and which said petition was approved for annexation to the city of Columbus by the Board of County Commissioners by order dated November 18, 2003, be and the same is hereby accepted and said territory is hereby annexed to the city of Columbus.  Said territory is described as follows:
 
Situate in the State of Ohio, County of Franklin, Townships of Hamilton and Madison and lying in Section 1, Township 3 North, Range 22 West and Section 6, Township 10 North, Range 21 West, Congress Lands, and being 5.791 acres of land, more or less, being all of the 1.330 and 1.900 acre tracts owned by Meridian Industrial Trust, Inc., (Parcel Numbers 150-002648 and 180-005254) and a portion of Port Road (formerly known as Curtis LeMay Avenue) of record in Plat Book 76, Page 46 and Plat Book 82, Page 6, all records herein of the Recorder's Office, Franklin County, Ohio, and said 5.791 acres of land being bounded and more particularly described as follows:
 
      Beginning at an angle point in the existing City of Columbus Corporation Line as established by Ordinance Number 1386-97 of record in Instrument Number 199710070113498, said point being in the southerly right-of-way line of Wright Brothers Avenue (60 feet in width) of record in Plat Book 82, Page 6, at the northwesterly corner of said 1.330 acre tract;
 
      Thence the following three (3) courses and distances along the said existing corporation line, a line common to the southerly right-of-way line of said Wright Brothers Avenue and the northerly lines of said 1.330 and 1.900 acre tracts:
      
1.      South 86° 09' 45" East, a distance of 210.35 feet, to a point of curvature;
      
2.      Along the arc of a curve to the left having an central angle of 20° 20' 32", a radius of 230.00 feet, an arc length of 81.66 feet, a chord that bears North 83° 39' 58" East, with a chord distance of 81.23 feet, to a point of tangency;
      
3.      North 73° 29' 42" East, a distance of 11.41 feet, to a point at the northeasterly corner of said 1.900 acre tract;
 
      Thence South 03° 50' 15" West, a distance of 449.15 feet, along the easterly line of said 1.900 acre tract, a line common to a 3.038 acre tract owned by Columbus Municipal Airport Authority, to a point at the southeasterly of said 1.900 acre tract, said point being in the northerly right-of-way line of said Port Road (150 feet in width);
 
      Thence the following two (2) courses and distances along the northerly right-of-way line of said Port Road:
 
 
1.      Along the arc of a curve to the left having an central angle of 06° 12' 20", a radius of 3199.05 feet, an arc length of 346.48 feet, a chord that bears North 75° 53' 35" East, with a chord distance of 346.31 feet, to a point of a compound curve;
      
2.      Along the arc of a curve to the left having an central angle of 92° 00' 06", a radius of 50.00 feet, an arc length of 80.29 feet, a chord that bears North 26° 47' 21" East, with a chord distance of 71.94 feet, to a point in the westerly right-of-way line of Alum Creek Drive (120 feet in width), also being the existing corporation line;
 
      Thence South 19° 12' 42" East, a distance of 250.14 feet, along the said existing corporation line across Port Road, to an angle point in said existing corporation line;
 
      Thence the following two (2) courses and distances along the southerly right-of-way line of Port Road:
 
1.      Along the arc of a curve to the left having an central angle of 88° 08' 44", a radius of 50.00 feet, an arc length of 76.92 feet, a chord that bears North 63° 17' 04" West, with a chord distance of 69.56 feet, to a point of reserve curve;
      
2.      Along the arc of a curve to the right having an central angle of 12° 17' 21", a radius of 3349.05 feet, an arc length of 718.33 feet, a chord that bears South 78° 47' 15" West, with a chord distance of 716.96 feet, to an angle point in the existing corporation line;
      
      Thence North 03° 50' 15" East, a distance of 647.20 feet, along the said existing corporation line, a line common to the westerly line of said 1.330 acre tract and the easterly line of a 5.747 acre tract owned by Meridian Industrial Trust, Inc., to the Point of Beginning, containing 5.791 acres, more or less, with 1.777 acres, more or less, lying in Hamilton Township and 4.014 acres, more or less, lying in Madison Township.
 
Section 2.  That the City Clerk is hereby authorized and directed to make three copies of this ordinance to each of which shall be attached a copy of the map accompanying the petition for annexation, a copy of the transcript of proceedings of the Board of County Commissioners relating thereto, and a certificate as to the correctness thereof, the City Clerk shall then forthwith deliver one copy to the County Auditor, one copy to the Board of Elections thereof and do such other things as may be required by law.
 
Section 3.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
