Explanation
Council Variance Application: CV23-096
APPLICANT: Cephas Pearson; c/o Brenda Parker, Agent; 405 North Front Street; Columbus, OH 43215.
NORTH CENTRAL AREA COMMISSION RECOMMENDATION: Disapproval.
PROPOSED USE: Two-unit dwellings.
CITY DEPARTMENTS' RECOMMENDATION: Approval. The site consists of three parcels in the R-3, Residential District. The center parcel is developed with a single-unit dwelling, and the adjacent parcels on each side are undeveloped. The requested Council variance will conform existing conditions for the single-unit dwelling, and will allow construction of a two-unit dwelling on each of the undeveloped lots. A Council variance is required because the R-3 district does not allow two-unit dwellings. Variances for reduced lot widths, lot sizes, and side yards are included in the request. The site is within the planning boundaries of the North Central Plan (2002), which recommends “Single-Family Residential” uses at this location. Staff supports the request as the proposed variance will conform the existing reduced side yard for the single-unit dwelling, and will allow two new two-unit dwellings on undeveloped lots, consistent with the existing housing types and the Plan’s recommendation for infill housing on vacant lots within residential areas.
Title
To grant a Variance from the provisions of Sections 3332.035, R-3 residential district; 3332.05, Area district lot width requirements; 3332.13, R-3 residential district requirements; 3332.26, Minimum side yard permitted, of the Columbus City Codes; for the property located at 1271 SIGSBEE AVE. (43219), to allow two-unit dwellings and reduced development standards in the R-3, Residential District (Council Variance #CV23-096).
Body
WHEREAS, by application #CV23-051, the owner of property at 1271 SIGSBEE AVE. (43219), is requesting a Council variance to allow two-unit dwellings with reduced development standards in the R-3, Residential District; and
WHEREAS, Section 3332.035, R-3 residential district, does not permit a two-unit dwelling, while the applicant proposes to develop a two-unit dwelling on each of the undeveloped parcels; and
WHEREAS, Section 3332.05, Area district lot width requirements, requires a minimum lot width of 50 feet in the R-3, Residential District, while the applicant proposes to maintain a lot width of 35± feet on the western and eastern lots; and
WHEREAS, Section 3332.13, R-3 residential district requirements, requires that a principal building shall be situated on a lot of no less than 5,000 square feet in area, while the applicant proposes a two-unit dwelling on a lot area of 3,675 square feet per dwelling unit on the western and eastern lots (pursuant to lot area calculation in 3332.18(C));
WHEREAS, Section 3332.26, Minimum side yard permitted, requires a minimum side yard of 3 feet, while the applicant proposes to maintain a minimum side yard of 2± feet for the existing single-unit dwelling on the center parcel along the eastern property line; and
WHEREAS, the North Central Area Commission recommends disapproval; and
WHEREAS, the City Departments recommend approval because this request is consistent with the land use recommendations and site design of the North Central Plan, and does not introduce an incompatible use to the area; and
WHEREAS, said ordinance requires separate submission for all applicable permits and Certificates of Occupancy for the proposed use; and
WHEREAS, said variance will not adversely affect the surrounding property or surrounding neighborhood; and
WHEREAS, the granting of said variance will not impair an adequate supply of light and air to the adjacent property, unreasonably increase the congestion of public streets, increase the danger of fires, endanger the public safety, unreasonably diminish or impair established property values within the surrounding area, or in any other respect impair the public health, safety, comfort, morals or welfare of the inhabitants of the City of Columbus; and
WHEREAS, the granting of said variance will alleviate the difficulties encountered by the owner of the property located at 1271 SIGSBEE AVE. (43219) in using said property as desired; now, therefore:
