DEVELOPMENT COMMISSION RECOMMENDATION: Approval (6-0) on May 9, 2024.
CITY DEPARTMENTS' RECOMMENDATION: Approval. The 142.5± acre site consists of three parcels developed with agricultural uses in the R, Rural District. The requested L-AR-1, Limited Apartment Residential District and CPD, Commercial Planned Development District will allow a mixed-use development with 11 subareas. Residential development will consist of 227 platted single-unit dwelling lots (Subarea A) and up to 1,007 multi-unit residential units, including townhouse style and apartment complex units (Subareas B1, B2, C1 and C2). Commercial development will consist of limited C-4 and C-5 uses (Subareas D1, D2, D3, and D4). Open space preservations will consist of 18.75 acres (Subareas E1 and E2). All subarea boundaries, private and public street networks, and open space commitments are shown on a submitted site plan. The site is within the planning boundaries of the Interim Hayden Run Corridor Plan (2004), which recommends “Environmentally Sensitive Development” land uses at this location. Columbus Citywide Planning Policies (C2P2) Design Guidelines (2018) recommend projects that propose a density higher than the recommended land use may be supported if high level site and architectural design are included. The proposal includes commitments to front dwelling units on the Heritage Trail and/or open spaces, connectivity between subareas, activation of open space, screening of parking and placement of parking behind buildings within commercial subareas, open space adjacent to the Heritage Trail, building design, setbacks, and building orientation, all consistent with the Plan and/or C2P2 Design Guidelines. A concurrent Council variance (Ordinance #2035-2025; CV24-097) is included with the project, and proposes reduced residential development standards.

WHEREAS, application #Z24-038 is on file with the Department of Building and Zoning Services requesting rezoning of 142.5± acres from the R, Rural District to the L-AR-1, Limited Apartment Residential District and CPD, Commercial Planned Development District; and
WHEREAS, the Development Commission recommends approval of said zoning change; and
WHEREAS, the City Departments recommend approval of the requested L-AR-1, Limited Apartment Residential District and CPD, Commercial Planned Development District because the proposal will allow a mixed-use development that includes design elements consistent with the Plan and C2P2 Design Guidelines. The proposal is also consistent with the City’s objective of creating more housing in all areas of the city; now, therefore:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Official Zoning Map of the City of Columbus, as adopted by Ordinance No. 0179 -03, passed February 24, 2003, and as subsequently amended, is hereby revised by changing the zoning of the property as follows:
7642 HAYDEN RUN RD. (43026), being 142.5± acres located on the north side of Hayden Run Road, southwest of the Heritage Trail, 4,000± feet west of Cosgray Road, and being more particularly described as follows:

SECTION 2. That a Height District of 60 feet is hereby established on the L-AR-1, Limited Apartment Residential District and CPD, Commercial Planned Development District on this property.
SECTION 3. That the Director of the Department of Building and Zoning Services be, and is hereby authorized and directed to make the said change on the said official zoning map and shall register a copy of the approved L-AR-1, Limited Apartment Residential District and CPD, Commercial Planned Development District, and Application among the records of the Department of Building and Zoning Services as required by Sections 3311.12 and 3370.03 of the Columbus City Codes; said plans titled, “SITE DEVELOPMENT PLAN, EXHIBIT 1,” “PARKLAND DEDICATION, EXHIBITS 1.1-1.2,” “DEVELOPMENT PLAN - SETBACK ENLARGEMENT, EXHIBIT 2,” “ENVIRONMENTAL TREATMENTS, EXHIBITS 15-20,”and said text titled, “LIMITATION & CPD TEXT,” all dated June 26, 2024, and signed by Thomas L. Hart, Attorney for the Applicant, and the text reading as follows:

SECTION 4. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
