REZONING APPLICATION:  Z02-071

 

APPLICANT:  Tansky Partners; c/o Jeffrey L. Brown, Atty.; 37 West Broad Street; Columbus, Ohio 43215.

 

PROPOSED USE:  Automobile sales.

 

DEVELOPMENT COMMISSION RECOMMENDATION:  Disapproval (2-2) on October 9, 2003.

 

CITY DEPARTMENTS' RECOMMENDATION:  Approval.  The proposed L-C-4, Limited Commercial District to expand an existing automobile dealership is consistent with existing zoning and development in this area.  In November 2002 Staff and the Development Commission supported applicant's request to rezone from the C-3, Commercial District to the L-C-4, Limited Commercial District to expand an automobile dealership.  The November 2002 limitation text included a commitment to remove an existing billboard.  Applicant has since decided that it would be in his best interest to retain the billboard and requested reconsideration by the Development Commission to delete the commitment to remove the billboard.  Staff supports this revsion to the limitation text because information provided to Zoning Clearance and Council Activities staff indicates that removal of the existing billboard would allow application for a new billboard at the southeast corner of  Sawmill and Dublin-Granville Roads if a utility pole is removed.

WHEREAS, application #Z02-071 is on file with the Building Services Division of the Department of Development requesting rezoning of 0.71± acres from C-3, Commercial District, to L-C-4, Limited Commercial District; and

 

WHEREAS, the Development Commission recommends disapproval of said zoning change; and

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the Official Zoning Map of the City of Columbus, as adopted by Ordinance No. 0179 -03, passed February 24, 2003, and as subsequently amended, is hereby revised by changing the zoning of the property as follows:

 

3715 West Dublin-Granville Road (43017), being 0.71± acres located on the south side of West Dublin-Granville Road, 522± feet east of Sawmill Road, and being more particularly described as follows:

 

Situated in the County of Franklin, in the State of Ohio, and in the City of Columbus:  Being that part of the former Morgan S. and Verna M. Wright tract, of record in Deed Book 1306, page 196, Recorder's Office, Franklin County, Ohio, conveyed to A.R. Turner Sr., by deed recorded January 7, 1956, in Deed Book 1931, page 569, Recorder's Office, Franklin County, Ohio; and being located in Township 2, Quarter Township 4, Range 19, United States Military Lands, more particularly bounded and described as follows:

 

Beginning at a point in the centerline of Dublin-Granville Road (U.S. Route No. 161) and the northerly line of said Wright tract; (which point bears South 54° 15' East 631.80 feet from a railroad spike marking the intersection of said centerline of Dublin-Granville Road with the centerline of Sawmill Road (westerly line of the said Wright tract)) which point also bears North 54° 15' West 1314.85 feet from the northeasterly corner of the said Wright tract;

 

thence South 54° 15' East, along the said centerline of Dublin-Granville Road, a distance of 100.0 feet;

 

thence South 26° 00' West, along a line drawn parallel to the easterly line of the said Turner tract, a distance of 311.85 feet, passing an iron pin at 50.73 feet, to an iron pin;

 

thence North 54° 15' West, along a line drawn parallel to the centerline of Dublin-Granville Road, a distance of 63.08 feet to an iron pin;

 

thence North 76° 20' 30" West, along a line drawn parallel to the south line of the said Wright tract, a distance of 37.25 feet to an iron pin;

 

thence North 26° 00' East, along a line drawn parallel to the said easterly line of the Turner tract, a distance of 326.06 feet, passing an iron pin at 275.33 feet, to the point of beginning, containing 0.712 acres of land but subject to all legal highways, and easements of record.

SECTION 2.  That a Height District of Thirty-five (35) feet is hereby established on the L-C-4, Limited Commercial District on this property.

 

SECTION 3.  That the Director of the Department of Development be, and he is hereby authorized and directed to make the said changes on the said original zoning map in the office of the Building Services Division and shall register a copy of the approved L-C-4, Limited Commercial District and Application among the records of the Building Services Division as required by Section 3370.03 of the Columbus City Codes; said text being titled, "LIMITATION OVERLAY TEXT DEVELOPMENT PLAN," signed by Jeffrey L. 1.  INTRODUCTION:  The text applies appropriate limitation standards to the site.

 

2.  PERMITTED USES:  Permitted uses on the subject site shall be those governed by Chapter 3356, C-4, Commercial District, Columbus City Code.  The following uses shall not be permitted:

 

bowling alley

cabaret, dance hall, night club, private club or pool room

carry-out, drive-in or fast-food business

cellular towers

portable and moveable free-standing signs

skating rink

stables

 

3.  DEVELOPMENT STANDARDS:  Except as otherwise noted, the applicable development standards of Chapter 3356, C-4, Commercial District shall apply to this property.

 

A.  Density, Height, Lot and/or Setback commitments.

 

1.  The parking setback shall be thirty (30) feet from Dublin-Granville Road.  The parking setback line also applies to the display of automobile/light trucks. 

 

2.  A thirty-five (35) foot height limitation shall be in effect.

 

B.  Access, Loading, Parking and/or other Traffic related commitments.

 

1.  If this site is used in conjunction with the adjacent automobile dealership to the west then this site shall have no curb cut to Dublin-Granville Road.  Otherwise access shall be subject to the review and approval of the City's Transportation Division.

 

C.  Buffering, Landscaping, Open space and/or Screening commitments.

 

1.  A landscaping feature consisting of a "Sawmill" fence shall be provided, and shall be set back seventy-five (75) feet from the centerline of Dublin-Granville Road.  (A "Sawmill" fence is a three rail wood fence.)

 

2.  All parking areas adjacent to Dublin-Granville Road shall have headlight screening of thirty (30) inches minimum height at installation along and parallel to the Dublin-Granville Road frontage, as measured from the elevation of the nearest section of the adjacent parking area.

 

3.  Lot coverage for structures and paved areas may not exceed eighty-five percent (85%) of the net usable area (gross zoned acreage excluding publicly dedicated streets).

 

4.  Loading areas shall be screened by opaque material and/or structures and/or landscaping to a minimum height of six (6) feet.

 

D.  Building design and/or Interior-Exterior treatment commitments.

E.  Dumpsters, Lighting, Outdoor display areas and/or other environmental commitments.

 

1.  All external outdoor lighting shall be cut-off fixtures (down lighting).

 

2.  All external outdoor lighting fixtures to be used shall be from the same or a similar manufacturer.

 

3.  All light poles and standards shall be brown, black or bronze in color and shall either be constructed of wood or brown, dark brown, black or bronze color metal.

 

4.  Parking lot lighting shall be no higher than twenty-eight (28) feet.

 

5.  No searchlights shall be permitted on the site.

 

6.  No motor vehicles shall be displayed from elevated ramps.

 

F.  Graphics and Signage commitments.

 

All graphics and signage shall comply with the Graphics Code, Article 15, Title 33 of the Columbus City Code as it applies to the C-4 Commercial District and any variance to the sign requirements shall be submitted to the Columbus Graphics Commission for consideration.

 

G.  Miscellaneous commitments.

 

The developer shall install a sidewalk along its West Dublin-Granville Road street frontage.

 

SECTION 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
