AN05-016
BACKGROUND: This ordinance is submitted to present to Council the transcript of proceedings and papers relating to Annexation AN05-016 a certain petition for annexation as described in the ordinance and transcript which is attached hereto. More than sixty days have elapsed since November 1, 2005, the date of receipt from the Board of County Commissioners of Franklin County.
These are submitted in accordance with the Ohio Revised Code.
FISCAL IMPACT: Provision of municipal services for a proposed annexation area has no fiscal impact. However, provision of the stated services does represent cost to the city. The annexation of land also has the potential to create revenue to the city.
Title
To accept the application (AN05-016) of Larry Worthington et al for the annexation of certain territory containing 9.8 ± Acres in Prairie Township.
Body
WHEREAS, a petition for the annexation of certain territory in Prairie Township was duly filed by Larry Worthington et al on September 21, 2005; and
WHEREAS, the said petition was duly considered by the Board of County Commissioners of Franklin County, Ohio, and the annexation of said hereinafter described territory to the city of Columbus was approved by said Commissioners by order dated October 6, 2005; and
WHEREAS, the Board of County Commissioners of Franklin County certified the transcript of the proceedings in connection with the said annexation with the map and petition required in connection therewith to the City Clerk who received the same on November 1, 2005; and
WHEREAS, sixty days from the date of said filing have now elapsed in accordance with the provisions of the Ohio Revised Code; and
WHEREAS, it is in the best interest of the city of Columbus to accept the annexation of the territory sought to be annexed by the aforesaid petition; now, therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS
Section 1. That the proposed annexation as applied for in the petition of Larry Worthington et al being the majority of owner(s) of real estate in the territory sought to be annexed and filed with the Board of County Commissioners of Franklin County, Ohio September 21, 2005 in which said petition prayed for annexation to the city of Columbus, Ohio, of certain territory adjacent thereto as hereinafter described, and which said petition was approved for annexation to the city of Columbus by the Board of County Commissioners by order dated October 6, 2005, be and the same is hereby accepted and said territory is hereby annexed to the city of Columbus. Said territory is described as follows:
Situated in the State of Ohio, County of Franklin, Township of Prairie, V.M.S. #5242 described as follows:
Beginning for reference in the northwest corner of Larry Worthington tract being 8.057 acres,
Thence in a easterly direction following the northerly line of 8.057 acre tract, a distance of 1413.54 feet, also being the existing City of Columbus Corporation line as established by City Ordinance number 1505-00, as recorded in the Recorder's Official Record Instrument Number 200009270196262;
Thence in a southerly direction along the original easterly right of way line of Galloway Road, a distance approximately 135 feet along Galloway Road to a point, also being the existing City of Columbus Corporation line as established by City Ordinance number 282-68, Miscellaneous Record #145-6;
Thence in a easterly direction approximately 15 feet to an existing easterly right of way line of Galloway Road to a point, also being the existing City of Columbus Corporation line as established by City Ordinance number 282-68, Miscellaneous Record #145-6;
Thence along the easterly right of way line of Galloway Road approximately 180 feet to a point;
Thence in a westerly direction, a distance of approximately 523.70 feet along the common line of 2.076 acre tract conveyed to Karen Basel, to a point found on the southwest corner;
Thence in a southerly direction, a distance of approximately 190.69 feet along the common line of 2.076 acre tract conveyed to Karen Basel to a point found on the southwest corner;
Thence in a westerly direction, a distance of approximately 222.32 feet along the common line of 4.807 acres conveyed to Larry Worthington to a point found on the southwest corner;
Thence in a northwesterly direction, a distance of approximately 830.42 feet following the easterly line of a 126.939 acre tract conveyed to Luther E. and Marie E. Kaderly to the Point of Beginning
Section 2. That the City Clerk is hereby authorized and directed to make three copies of this ordinance to each of which shall be attached a copy of the map accompanying the petition for annexation, a copy of the transcript of proceedings of the Board of County Commissioners relating thereto, and a certificate as to the correctness thereof, the City Clerk shall then forthwith deliver one copy to the County Auditor, one copy to the Board of Elections thereof and do such other things as may be required by law.
Section 3. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
