Explanation

1.  BACKGROUND

This legislation authorizes the Director of Public Service to modify and increase an existing contract with OHM Advisors for the Pedestrian Safety Improvements - Refugee Road-Winchester Pike to Hamilton Road contract in an amount up to $700,000.00.   

 

Ordinance 2496-2015 authorized the preliminary and final engineering for pedestrian improvements to Refugee Road from Winchester Pike to Hamilton Road.  The project is to install a shared use path on one side of Refugee Road and sidewalk on the other side from Winchester Pike to Hamilton Road.

 

Work performed to date for this project includes the preliminary engineering study and the beginning of detailed design and construction plan preparation services.

                     

The original contract amount:                                     $335,989.61      (EL017629, Ord. 2496-2015)                         

The total of Modification No. 1:                                 $700,000.00      (Current Ord.)

The contract amount including all modifications:         $1,035,989.61  

 

Searches in the Excluded Party List System (Federal) and the Findings for Recovery list (State) produced no findings against OHM Advisors. 

 

2. PLANNED MODIFICATION

This is a planned modification.  This modification will provide additional funding relative to the completion of the detailed design of improvements in the amount of $700,000.00 as stated in the original ordinance, 2496-2015.  

 

Any additional modifications that are planned to complete the design phase shall require the Director to seek Council approval to modify this contract and expend additional funds.

 

3.  CONTRACT COMPLIANCE

The contract compliance number for OHM Advisors (Vendor Number 007505) is 38-1691323 and expires 2/18/18.

 

4.  FISCAL IMPACT

Funds in the amount of $700,000.00 are available for this project in the Streets and Highways G.O. Bond Fund within the Department of Public Service. 

 

5.  EMERGENCY DESIGNATION

Emergency action is requested to provide necessary design funding to prevent delays in the Departments of Public Service’s Capital Improvement Program.

Body

WHEREAS, contract no. EL017629, in the amount of $335,989.61, with OHM Advisors was authorized by ordinance no. 2496-2015; and

 

WHEREAS, the Department of Public Service has determined it to be in the City's best interest to modify the subject contract for the purpose of performing detailed design for Pedestrian Safety Improvements - Refugee Road-Winchester Pike to Hamilton Road project; and

 

WHEREAS, this is a planned modification and the Director of Public Service may request additional, future planned modifications for additional phases; and

 

WHEREAS, it is necessary to authorize the Director of the Department of Public Service to enter into a contract modification to the Pedestrian Safety Improvements - Refugee Road-Winchester Pike to Hamilton Road contract in an amount up to $700,000.00 with OHM Advisors; and

 

WHEREAS, the total contract amount, including this modification, is $1,035,989.61; and

 

WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service in that it is immediately necessary to authorize the Director to modify the agreement with OHM Advisors so that funding can be made available to allow survey work to be completed before the winter months, thereby preserving the public health, peace, property, safety and welfare; now, therefore

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the Director of Public Service be and is hereby authorized to modify and increase contract no. EL017629 with OHM Advisors, 580 North Fourth Street, Suite 610, Columbus, Ohio 43215, by up to $700,000.00 for additional work in accordance with the terms as shown on the contract modification on file in the Office of Support Services.

                     

SECTION 2.  That the expenditure of $700,000.00, or so much thereof as may be needed, is hereby authorized in Fund 7704, Streets and Highways G.O. Bond Fund in Object Class 06, Capital Outlay, per the accounting codes in the attachment to this ordinance.

 

SECTION 3.  That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 4.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

SECTION 5.  That the City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project.

 

SECTION 6.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
