Explanation

1. BACKGROUND

Ordinance 2453-2025, passed November 3, 2025, authorized the Director of Columbus Water and Power to enter into a Guaranteed Maximum Reimbursement Agreement (GMRA) with Western Property, LLC for the Upper Scioto West Subtrunk - West of Cosgray Road Jameson Estates project, CIP# 650497-100002, in an amount up to $7,328,451.00, pursuant to Section 186 (Public Improvements by Contract or Direct Labor) of the Columbus City Charter. 

 

Upon passage of the Ordinance, the City of Columbus agreed to pay a maximum reimbursement amount of up to $7,328,451.00 to Western Property, LLC for construction of the Upper Scioto West Subtrunk - West of Cosgray Road Jameson Estates project, CIP# 650497-100002.  The developer has agreed to construct the improvements at their cost and then obtain reimbursement from the City.  The guaranteed maximum reimbursement agreement provides the developer constructs the public improvement on the City's behalf, the project is publicly bid and follows the City’s bid processes, the developer submits requests for reimbursement of construction costs related to the project, only pre-approved construction costs are reimbursed, and there is a limit to the dollar amount of costs that will be reimbursed.

 

2. BID WAIVER REQUEST

Section four (4) of the Construction Guaranteed Maximum Reimbursement Agreement requires the Developer to adhere to the Department of Columbus Water and Power Competitive Bid Construction Services Process unless authorized by City Council and the Director of Columbus Water and Power to waive said process. CWP respectfully requests the waiver to expedite the project.

3. FISCAL IMPACT

There is no fiscal impact with this ordinance.

Body

WHEREAS, the City of Columbus, acting through Columbus Water and Power, has entered into a Guaranteed Maximum Reimbursement Agreement with Western Property, LLC for the Upper Scioto West Subtrunk - West of Cosgray Road Jameson Estates project; and

 

WHEREAS, Section 4 of the Guaranteed Maximum Reimbursement Agreement requires the Developer to adhere to the Department of Columbus Water and Power Competitive Bid Construction Services Process unless authorized by City Council and the Director of Columbus Water and Power to waive said process; and

 

WHEREAS, this Council has determined that it is in the best interests of the City to waive the Competitive Bid Construction Services Process for the Upper Scioto West Subtrunk - West of Cosgray Road Jameson Estates project; and

 

WHEREAS,  it is necessary in the daily operation of Columbus Water and Power to authorize waiver of bid requirements for the Guaranteed Maximum Reimbursement Agreement with Western Property, LLC for the Upper Scioto West Subtrunk - West Of Cosgray Road Jameson Estates project now, therefore

 

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1. That, pursuant to Section 4 of the Guaranteed Maximum Reimbursement Agreement, City Council hereby waives the Department of Columbus Water and Power Competitive Bid Construction Services Process for the Upper Scioto West Subtrunk - West of Cosgray Road Jameson Estates project.

 

SECTION 2. That the Director of Columbus Water and Power, or designee, is hereby authorized to take such actions as are necessary to implement the waiver authorized by this Ordinance.

 

SECTION 3.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
