Council Variance Application:  CV24-079

 

APPLICANT:  Metro Development, LLC, c/o Jeffrey L. Brown, Atty.; 37 West Broad Street, Suite 460; Columbus, OH 43215.

PROPOSED USE:  Apartment complex.

 

WESTLAND AREA COMMISSION RECOMMENDATION: Approval.

 

CITY DEPARTMENTS' RECOMMENDATION: Approval. The applicant has received a recommendation of disapproval from Staff and a recommendation of approval from the Development Commission for a concurrent rezoning request to the L-AR-1, Limited Apartment Residential District (Ordinance #3327-2024; Z24-027) for a 408-unit apartment complex. Variances to reduce the building setback along Georgesville Road from 80 feet to 25 feet, and to increase the height of detached garages from 15 feet to 16 feet are included in the request. The request is consistent with similar reduced setbacks and increased garage heights for apartment complex developments, allowing a site design that places parking behind buildings, and garage roof pitch that better compliments the apartment buildings’ design.

To grant a Variance from the provisions of Sections 3333.18, Building lines; and 3333.35(G), Private garage, of the Columbus City Codes; for the property located at 5255 CROSSWIND DR. (43228), to allow reduced development standards for an apartment complex in the L-AR-1, Limited Apartment Residential District (Council Variance #CV24-079).

 

Body

 

WHEREAS, by application #CV24-079, the owner of property at 5255 CROSSWIND DR. (43228), is requesting a Council variance to allow reduced development standards for an apartment complex in the L-AR-1, Limited Apartment Residential District; and

 

WHEREAS, Section 3333.18, Building lines, requires a minimum building setback of 80 feet from Georgesville Road, while the applicant proposes a reduced building setback of 25 feet; and

 

WHEREAS, Section 3333.35(G), Private garage, restricts the height of a private detached garage to 15 feet, while the applicant proposes to increase the allowable height to 16 feet; and

 

WHEREAS, the Westland Area Commission recommends approval; and

 

WHEREAS, the City Departments recommend approval as the requested variances are consistent with similar reduced setbacks and increased garage heights for apartment complex developments, allowing a site design that places parking behind buildings, and garage roof pitch that better compliments the apartment buildings’ design; and

 

WHEREAS, said ordinance requires separate submission for all applicable permits and Certificates of Occupancy for the proposed apartment complex; and

 

WHEREAS, said variance will not adversely affect the surrounding property or surrounding neighborhood; and

 

WHEREAS, the granting of said variance will not impair an adequate supply of light and air to adjacent properties or unreasonably increase the congestion of public streets, or unreasonably diminish or impair established property values within the surrounding area, or otherwise impair the public health, safety, comfort, morals, or welfare of the inhabitants of the City of Columbus; and

 

WHEREAS, the granting of said variance will alleviate the difficulties encountered by the owners of the property located at 5255 CROSSWIND DR. (43228), in using said property as desired; now, therefore:

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1. That a variance from the provisions of Sections 3333.18, Building lines; and 3333.35(G), Private garage, of the Columbus City Codes; is hereby granted for the property located at 5255 CROSSWIND DR. (43228), insofar as said sections prohibit a reduced building setback from Georgesville Road from 80 feet to 25 feet, and an increased garage height from 15 feet to 16 feet; said property being more particularly described as follows:

 

5255 CROSSWIND DR. (43228), being 21.06± acres located on the southeast corner of Crosswind Drive and Krieger Street, and being more particularly described as follows:

 

Situated in the State of Ohio, County of Franklin, City of Columbus and being in Virginia Military Survey Number 1462 and also being 21.06± acres of a 23.560 acre tract as conveyed to Capital Square, LTD. in Instrument Number 199712310179272 as further described as follows;

 

Commencing at an angle point in the south line of said 23.560 acre tract, being the northeast corner of Georgesville Road (R/W Varies) as create in the Dedication of Kreiger Street, Crosswind Drive and Georgesville Road in Plat Book 49, Page 35, the northwest corner of Georgesville Road as created in the Dedication of Georgesville Road, Hall Road & Boltonfield Street in Plat Book 45, Page 68;

 

Thence with the south line of said 23.560 acre tract and the northerly right of way line of Georgesville Road as dedicated in said Plat Book 49, Page 35, S 76° 37' 36" W, 38.95± feet to the TRUE POINT OF BEGINNING for the land herein described as follows;

 

Thence the following five (5) courses with the south line of said 23.560 acre tract and the northerly right of way line of Georgesville Road as dedicated in said Plat Book 49, Page 35:

 

1. S 76° 37' 36" W, 255.53± feet;

 

2. S 74° 22' 12" W, 689.78± feet;

 

3. S 89° 22' 12" W, 123.64± feet;

 

4. S 74° 22' 12" W, 80.57± feet;

 

5. N 60° 37' 48" W, 42.42± feet to a point of curvature in the easterly right of way line of Krieger Street (60’ R/W) as dedicated in said Plat Book 49, Page 35 and being an angle point in the west line of said 23.560 acre tract;

 

Thence the following four (4) courses with the west line of said 23.560 acre tract and the easterly right of way line of Krieger Street as dedicated in said Plat Book 49, Page 35:

 

1. Along a curve to the right having a central angle of 11° 20' 12", a radius of 314.05± feet, an arc length of 62.14± feet, and a chord bearing and distance of N 04° 28' 48" W, 62.04± feet to a point of tangency;

2. N 01° 11' 18" E, 474.31± feet;

 

3. Along a curve to the left having a central angle of 16° 47' 12", a radius of 530.00± feet, an arc length of 155.28± feet, and a chord bearing and distance of N 07° 12' 15" W, 154.73± feet to a point of curvature;

 

4. Along a curve to the right having a central angle of 87° 17' 51", a radius of 20.00± feet, an arc length of 30.47± feet, and a chord bearing and distance of N 28° 03' 04" E, 27.61± feet to a point of curvature in the southerly right of way line of Crosswind Drive (80’ R/W) as dedicated in said Plat Book 49, Page 35 and being an angle point in the north line of said 23.560 acre tract;

 

Thence the following six (6) courses with the north line of said 23.560 acre tract and the southerly right of way line of Crosswind Drive as dedicated in said Plat Book 49, Page 35:

 

1. Along a curve to the left having a central angle of 04° 25' 02", a radius of 1040.00± feet, an arc length of 80.18± feet, and a chord bearing and distance of N 69° 29' 28" E, 80.16± feet;

 

2. Along a curve to the right having a central angle of 09° 20' 29", a radius of 1460.00± feet, an arc length of 238.04± feet, and a chord bearing and distance of N 71° 57' 12" E, 237.77± feet;

 

3. N 76° 37' 27" E, 637.92± feet;

 

4. Along a curve to the right having a central angle of 24° 00' 01", a radius of 710.00± feet, an arc length of 297.41± feet, and a chord bearing and distance of N 88° 37' 27" E, 295.24± feet;

 

5. S 79° 22' 33" E, 105.00± feet;

 

6. Along a curve to the right having a central angle of 86° 44' 48", a radius of 20.00± feet, an arc length of 30.28± feet, and a chord bearing and distance of S 35° 58' 16" E, 27.47± feet to the westerly right of way line of Boltonfields Street (80’ R/W) as dedicated in said Plat Book 45, Page 68 and being an angle point in the north line of said 23.560 acre tract;

 

Thence with the east line of said 23.560 acre tract and the westerly right of way line of Boltonfields Street as dedicated in said Plat Book 45, Page 68 along a curve to the left having a central angle of 11° 14' 45", a radius of 1040.00± feet, an arc length of 204.13± feet, and a chord bearing and distance of S 01° 45' 20" W, 203.80± feet;

 

Thence crossing said 23.560 acre tract, S 76° 37' 36" W, 283.23± feet;

 

Thence continuing across said 23.560 acre tract, S 13° 22' 25" E, 423.81± feet to the TRUE POINT OF BEGINNING, containing 21.06± acres, more or less.

SECTION 2.  That this ordinance is conditioned on and shall remain in effect only for so long as said property is used for those uses permitted in the L-AR-1, Limited Apartment Residential District, specified by Ordinance #3327-2024; Z24-027. 

 

SECTION 3.  That this ordinance is further conditioned on the applicant obtaining all applicable permits and Certificates of Occupancy for the proposed apartment complex.

 

SECTION 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
