CITY DEPARTMENTS' RECOMMENDATION: Approval. The site consists of one undeveloped parcel in the R, Rural District. The requested Council Variance will allow the site to be developed with a two-unit dwelling. A Council variance is required because the R district only allows single-unit dwellings as a primary residential land use. Variances to parking setback, vision clearance, lot area, building lines, maximum side yard, minimum side yard, and rear yard are also included in this request. The request is consistent with the Southwest Area Plan’s (2009) land use recommendation of “Low Density Residential” and Columbus Citywide Planning Policies (C2P2) Design Guidelines as the project includes a high-level of site and architectural design and is compatible with the surrounding residential development.

WHEREAS, by application #CV25-058, the owner of the property at 1815-1817 TANIS DR. (43123), is requesting a Council variance to allow a two-unit dwelling with reduced development standards in the R, Rural District; and
WHEREAS, Section 3332.02, R-rural district, allows one single-unit dwelling on a lot, while the applicant proposes a two-unit dwelling; and
WHEREAS, Section 3312.27, Parking setback line, requires a parking setback line of 25 feet along Tanis Drive, while the applicant proposes a reduced parking setback line of seven feet; and
WHEREAS, Section 3321.05(B)(2), Vision clearance, requires a clear vision triangle of 30 feet at street intersections, while the applicant proposes to reduce the 30-foot clear vision triangle at the southwest corner of Tanis Drive and Lazar Road to 26 feet, as shown on the submitted site plan; and
WHEREAS, Section 3332.06, R-rural area district requirements, requires that a principal building shall be situated on a lot of no less than five acres, while the applicant proposes a reduced lot area of 0.11 acres; and
WHEREAS, Section 3332.21(B), Building lines, requires a minimum building setback line of 25 feet from Tanis Drive, while the applicant proposes a reduced building line of five feet for the proposed two-unit dwelling; and
WHEREAS, 3332.25, Maximum side yards required, requires that the sum of the widths of the side yards equal or exceed 20 percent of the width of the lot, or 16.6 feet for a lot width of 83 feet, while the applicant proposes reduced maximum side yards totaling 12 feet for the proposed two-unit dwelling; and
WHEREAS, Section 3332.26, Minimum side yard permitted, requires a minimum side yard of 7.5 feet, while the applicant proposes a reduced side yard of seven feet along the western property line and five feet along the eastern property line; and
WHEREAS, 3332.27, Rear yard, requires each dwelling, residence or principal building shall be erected so as to provide a rear yard totaling no less than 25 percent of the total lot area, while the applicant proposes a reduced rear yard of 15 percent for the proposed two-unit dwelling; and
WHEREAS, the Southwest Area Commission recommends approval; and
WHEREAS, the City Departments recommend approval because the request includes a high level of site and architectural design that is consistent with the Southwest Area Plan and C2P2 Design Guidelines and is compatible with the surrounding residential development; and
WHEREAS, said ordinance requires separate submission for all applicable permits and a Certificate of Occupancy for the proposed two-unit dwelling; and
WHEREAS, said variances will not adversely affect the surrounding property or surrounding neighborhood; and
WHEREAS, the granting of said variances will not impair an adequate supply of light and air to the adjacent property, unreasonably increase the congestion of public streets, increase the danger of fires, endanger the public safety, unreasonably diminish or impair established property values within the surrounding area, or in any other respect impair the public health, safety, comfort, morals or welfare of the inhabitants of the City of Columbus; and
WHEREAS, the granting of said variance will alleviate the difficulties encountered by the owner of the property located at 1815-1817 TANIS DR. (43123), in using said property as desired; now, therefore:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That a variance from the provisions of Sections 3332.02, R-rural district; 3312.27, Parking setback line; 3321.05(B)(2), Vision clearance; 3332.06, R-rural area district requirements; 3332.21(B), Building lines; 3332.25, Maximum side yards required; 3332.26, Minimum side yard permitted; and 3332.27, Rear yard, of the Columbus City Codes; is hereby granted for the property located at 1815-1817 TANIS DR. (43123), insofar as said sections prohibit a two-unit dwelling in the R, Rural District, with a reduced parking setback line from 25 feet to seven feet from Tanis Drive; a reduced vision clearance triangle at the southwest corner of Tanis Drive and Lazar Road from 30 feet to 26 feet; a reduced lot area from five acres to 0.11 acres; a reduced building line from 25 feet to five feet along Tanis Drive for the proposed two-unit dwelling; a reduced maximum side yard from 16.6 feet to 12 feet; a reduced minimum side yard from 7.5 feet to seven feet along the western property line, and to five feet along the eastern property line; and a reduced rear yard from 25 percent to 15 percent; said property being more particularly described as follows:

SECTION 2. That this ordinance is conditioned on and shall remain in effect only for so long as said property is used for a two-unit dwelling, in accordance with the submitted site plan, or those uses allowed in the R, Rural District.
SECTION 3. That this ordinance is further conditioned on the subject site being developed in general conformance with the site plan titled, "SITE PLAN," dated September 8, 2025, and signed by Jonathan Romanovich, Applicant. The plan may be slightly adjusted to reflect engineering, topographical, or other site data developed at the time of the development and when engineering and architectural drawings are completed. Any slight adjustments to the plan shall be subject to review and approval by the Director of the Department Building and Zoning Services, or a designee, upon submission of the appropriate data regarding the proposed adjustment.
SECTION 4. That this ordinance is further conditioned upon the applicant obtaining all applicable permits and a Certificate of Occupancy for the proposed two-unit dwelling.
SECTION 5. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
