Explanation
BACKGROUND
This legislation authorizes the Director of the Department of Development to enter into a not-for-profit service contract with Franklin County Public Health, in an amount up to $80,400.00 to provide lead risk inspection/assessor services to the Lead Safe Columbus program. The term of this contract shall be through the program year 2026 with the option to renew for one (1) additional year.
The funding for the Lead Safe Columbus (LSC) Program is obtained through the U.S. Department of Housing and Urban Development (HUD) for release of funds from the Lead Hazard Reduction Demonstration Grant Program, authorized by Sec. 1011 of the Residential Lead-Based Paint Hazard Reduction Act of 1992 (Title X of the Housing & Community Development Act of 1992) for the following multi-year project: Lead Safe Columbus grant period running March 1, 2025 through March 1, 2029.
The funding for the Lead Safe Ohio Program is obtained through the Ohio Department of Development (ODOD) for lead-safe renovation, repair, painting and abatement as appropriate. Residential dwellings built on or before 1978 and where household’s income is at or below 80% Area Media Income (AMI) are eligible for the program. Households where income is above 80% AMI but less than 120% AMI can qualify if a lead hazard is identified. Childcare facilities and congregate shelters built prior to 1978 are also eligible. Approved applicants could receive home repairs including roof replacement, window and door replacement, and mechanical repairs. If the house was built prior to 1978 and the scope of work exceeds $25,000, the selected Contractor would be assigned to perform lead inspections, risk assessment reports, work specifications, and final lead clearance testing in privately-owned residential housing units.
Franklin County Public Health would be assigned to perform and provide risk assessment reports, work specifications, and final lead clearance testing residential homes, residential and commercial childcare facilities, and congregate shelters.
The Department of Development advertised RFQ029435 on Vendor Services and proposals seeking contracts to provide lead safe abatement services for residential properties on December 17, 2024 with bids being due on January 27, 2025.
The services included in this not-for-profit service contract cannot be provided by existing city employees as they are beyond the City’s current staffing capacity to provide.
Emergency action is requested to continue performing the needed services for residents as quickly as possible.
FISCAL IMPACT: Funding is available within the ODOD LEAD Grant (G442400) Fund budget; Lead-24 Grant (G442500); and the Housing Division’s 2025 General Fund budget for this purpose.
CONTRACT COMPLIANCE: the vendor number is 006183 and expires 10/17/2025.

To authorize the Director of Department of Development to enter into a not-for-profit service contract in an amount up to $80,400.00 with Franklin County Public Health, to provide lead risk inspection/assessor services to the Lead Safe Columbus program; and to authorize the expenditure in an amount up to $50,400.00, using LHR24 Grant, up to $10,000.00, using ODOD LEAD Grant, and up to $20,000.00, using general fund; and to declare an emergency. WHEREAS, the Lead-Safe Home Renovations Program was established to assist low and moderate income homeowners with lead abatement services that would impact a household remaining safely in their home; and
WHEREAS, the Department of Development advertised RFQ029435 on Vendor Services in January 2025 for Licensed Lead Risk Inspector/Assessor services for the Lead Safe Columbus program; and
WHEREAS, the Director of Development wishes to enter into a contract with Franklin County Public Health to carry out program services; and
WHEREAS, the services included in this not-for-profit service contract cannot be provided by existing city employees as they are beyond the City’s current staffing capacity to provide; and
WHEREAS, the expenditure for Licensed Lead Risk Inspector/Assessor services is needed in an amount up to $50,400.00, from the LHR24 Grant; up to $10,000.00, from the ODOD LEAD Grant; and up to $20,000.00, from the General Fund;
WHEREAS, an emergency exists in the usual daily operation of the Department of Development in that it is immediately necessary to authorize the Director to enter into a not-for-profit service contract with Franklin County Public Health as there exists no current lead assessor to provide services under the Lead Safe Columbus program, all for the immediate preservation of the public health, peace, property, safety and welfare; and NOW THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Director of the Department of Development be and is hereby authorized to enter into a not-for-profit service contract, in an amount up to $80,400.00, with Franklin County Public Health, to provide residential Lead Risk Inspector/Assessor services as part of the Division of Housing’s Lead Safe Columbus program. The term shall be through December 31, 2025, with an option to renew for one year periods until December 31, 2028.
SECTION 3. That for the purpose as stated in Section 1, the expenditure in an amount of $50,400.00 or so much thereof as may be needed, is hereby authorized in Fund 2220 (General Government Grants Fund), Project G442500, Dept-Div 4410 (Housing), in object class 03 (Services) per the accounting codes in the attachment to this ordinance.
SECTION 2. That for the purpose as stated in Section 1, the expenditure of $10,000.00 or so much thereof as may be needed, is hereby authorized in Fund 2220 (General Government Grant Fund), Project G442400, Dept-Div 4410 (Housing), object class 03 (Services) which funding was previously authorized by Ordinance 3209-2023 and ACPO010294.
SECTION 4. That for the purpose as stated in Section 1, the expenditure of $20,000.00 or so much thereof as may be needed, is hereby authorized in Fund 1000 (General Fund), Dept-Div 4410 (Housing), in object class 03 (Services) per the accounting codes in the attachment to this ordinance.
SECTION 5. That this contract is awarded pursuant to the relevant provisions of Chapter 329 of City Code relating to not-for-profit service contracts.
SECTION 6. That the funds necessary to carry out the purpose of this ordinance are deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.
SECTION 7. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
SECTION 8. That for the reasons stated in the Preamble hereto, which is hereby made a part hereof, this Ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
