Explanation

 

BACKGROUND:

This ordinance approves the acceptance of certain territory (AN22-016) by the city of Columbus. The Ohio Revised Code stipulates that to be effective, City acceptance must take place a minimum of 60 days from the receipt by the City Clerk of the approval notice from the county. If City Council does not accept the ordinance within 120 days of its first consideration, the annexation will be considered rejected. This petition was filed with Franklin County on March 22, 2023. City Council approved a service ordinance addressing the site on April 3, 2023. Franklin County approved the annexation on August 22, 2023 and the City Clerk received notice on August 31, 2023.

FISCAL IMPACT:

Provision of municipal services does represent cost to the City; however, the annexation of land also has the potential to create revenue to the City.

To accept the application (AN22-016) of Masjid Abdulrahman & Mamadou Bah for the annexation of certain territory containing 1.37± acres in Madison Township.

 

 

Body

 

WHEREAS, a petition for the annexation of certain territory in Madison Township was filed on behalf of Masjid Abdulrahman & Mamadou Bah on March 22, 2023; and

WHEREAS, the petition was considered and approved by the Franklin County Board of Commissioners at a hearing on August 22, 2023; and

WHEREAS, on August 31, 2023, the City Clerk received from Franklin County a certified copy of the resolution addressing the petition; and

WHEREAS, sixty days have now elapsed since receipt of the resolution in accordance with the provisions of the Ohio Revised Code; and

WHEREAS, it is in the best interest of the city of Columbus to accept the annexation of the territory addressed by the petition; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS

SECTION 1. That the annexation proposed by Masjid Abdulrahman & Mamadou Bah in a petition filed with the Franklin County Board of Commissioners on March 22, 2023 and subsequently approved by the Board on August 22, 2023 is hereby accepted and said territory is hereby annexed to the city of Columbus. Said territory is described as follows:

Situated in the State of Ohio, County of Franklin, Township of Madison, Northeast Quarter of Section 12, Township 11, Range 21, Mathew1s Survey of Congress Lands, being all of Lot 14 of MACK-ANN SUBDIVISION, as recorded in Plat Book 29, Page 47, all of Tracts I and II conveyed to Masjid Abdulrahman (Auditor1s Parcel No. 181-000576) by Instrument Number 202208040113354), all of the 0.34 acre tract conveyed to Franklin County Commissioners by Instrument Number 200304170112901 and 0.08 acres out of the 0.667 acre tract conveyed to City of Columbus by Official Record Volume 107441-15, all references being to the Franklin County Recorder's Office, and being more particularly described as follows:

Beginning at the northeast corner of said Lot 14, northeast corner of said Tract I and in the southerly line of said Tract II, at the northwest corner of the 10.889 acre tract conveyed to Balaloski Properties LLC, being an angle point in an existing City of Columbus Corporation line established by Ordinance Number 372-02 and recorded in Instrument Number 200207030164084;

Thence, southerly along the east line of said Lot 14 and existing corporation line, approximately 100 feet to the southeast corner of said Lot 14;

Thence, westerly, along the southerly line of said Lot 14, approximately 200 feet to the southwest corner of said Lot 14 and said 0.34 acre tract, and in the original right-of-way of Gender Road (County Road #222, also being an existing City of Columbus Corporation Line as established by Ordinance No. 825-74 and recorded in Miscellaneous Record Volume 162, Page 771;

Thence, northerly, along said right-of-way and west line of said Lot 14, west line of said 0.34 and 0.667 acre tracts and said corporation line, approximately 250 feet;

Thence, easterly, across said 0.667 acre tract, along the northerly line of said Tract I, and the southerly line of the 5.652 acre tract conveyed to Board of Park Commissioners of Columbus Franklin County Metro Park District, approximately 265 feet to the northeast corner of said Tract I;

Thence, southerly, along the easterly line of said Tract I, approximately 150 feet to the southeast corner of said Tract I and in said existing corporation line (Ordinance No. 3702-02);

Thence, westerly along said corporation line, approximately 65 feet to the place of beginning, CONTAINING APPROXIMATELY 1.37 ACRES.

THE ABOVE DESCRIPTION WAS PREPARED BY MATTHEW D. FARLEY, PROFESSIONAL SURVEYOR NO. 7566 IN OCTOBER 2022 FROM RECORDS OF THE FRANKLIN COUNTY ENGINEER, AUDITOR AND RECORDER'S OFFICES, AND IS NOT INTENDED FOR FEE SIMPLE TRANSFER.

SECTION 2. That the City Clerk is hereby authorized and directed to make three copies of this ordinance to each of which shall be attached a copy of the map accompanying the petition for annexation, a copy of the transcript of proceedings of the Board of County Commissioners relating thereto, and a certificate as to the correctness thereof, the City Clerk shall then forthwith deliver one copy to the County Auditor, one copy to the Board of Elections thereof and do such other things as may be required by law.

SECTION 3. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
