Explanation
 
Background:  This legislation authorizes the City to enter into a contract in an amount up to $849,005.37 for the Hamilton Road at Livingston Avenue Intersection Improvement project, to pay construction inspection costs up to $92,000.00 and to reimburse the Division of Power and Water for Power utility relocation costs of up to $10,000.00.  This improvement adds right turn lanes, constructs a new traffic signal and ADA compliant ramps and reconstructs sidewalks in the immediate vicinity. The estimated Notice to Proceed date is on or before June 23, 2008. This project has been given 152 days to complete the construction of the project.  The project was let by the Transportation Division and was advertised in the City Bulletin, Dodge Reports, and by the Builders Exchange.  10 bidders/suppliers were solicited (9 majority, 1 minority) and 4 bids were received on March 6, 2008 (4 majority) and tabulated on March 7, 2008 as follows:

Complete General Construction Company                 $931,171.55
 
Award is to be made to Decker Construction Company, c.c. #31-0983557 (expiring November 26, 2009), as the lowest, best, most responsive and most responsible bidder.
 
Emergency action is requested to allow the construction of this project  to commence at the earliest possible time in this construction season.
 
Fiscal Impact:  Funding for this project is budgeted within the Transportation Division as part of the Capital Improvement Program and is available within the Voted 1995, 1999, 2004 Streets and Highways Fund for this work.

Body
 
WHEREAS, bids were received on March 6, 2008, and tabulated on March 7, 2008, for the Hamilton Road at Livingston Avenue Intersection Improvement project and a satisfactory bid has been received; and
 
WHEREAS, it is necessary to provide for construction inspection costs; and
 
WHEREAS, an emergency exists in the usual daily operation of the Transportation Division in that the contract should be awarded immediately so that the work may proceed without delay during the construction season, thereby preserving the public health, peace, property, safety and welfare; now, therefore
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1.  That the Public Service Director be and is hereby authorized to enter into a contract with Decker Construction Company for the construction of the Hamilton Road at Livingston Avenue Intersection Improvement project in an amount up to $849,005.37, for the Transportation Division in accordance with the specifications and plans on file in the office of the Public Service Director, which are hereby approved; to obtain and pay for the necessary inspection costs associated with the project up to a maximum of $92,000.00 and to reimburse the Division of Power and Water for relocation costs associated with this project in an amount up to $10,000.00.
 
SECTION 2.  That for the purpose of paying the cost of the contract, inspection and utility relocation the sum of $951,005.37 or so much thereof as may be needed, is hereby authorized to be expended from the Voted 1995, 1999, 2004 Streets and Highways Fund, No. 704,  for the Transportation Division, Dept.-Div. 59-09, OCA Code 644385,   O.L 01-03 Code 06-6631, and project 530086 (Intersection Improvements).
SECTION 3.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
 
SECTION 4.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
