Explanation
 
MARONDA HOMES INC. OF OHIO, an Ohio corporation, by JAMES F. BAUER, Executive Vice President has submitted the plat titled MEADOWS AT SHANNON LAKES SECTION ONE.  This plat was approved by the Council of the City of Columbus as TOWN SQUARE VILLAGES AT SHANNON ROAD SECTION 1 in Ordinance # 0972-03.  Maronda Homes wishes to change the name of the subject plat to avoid any conflict with the use of the existing name of the Plat and the name of the owners association, as created by the former developer.  There are no other changes to this plat.  The following legislation repeals Ordinance # 0972-03 and accepts the same plat for property located south off of Shannon Road, west of Brice Road.

Body
 
WHEREAS, pursuant to Ordinance # 0972-03 the  Council of the City of Columbus accepted the plat titled TOWN SQUARE VILLAGES AT SHANNON ROAD SECTION 1; and
 
WHEREAS, MARONDA HOMES INC. OF OHIO, an Ohio corporation, desires to develop the property as set forth in the plat, but Maronda desires to change the name of the plat to avoid any conflict with the use of the existing name of the plat and the name of the owners association, as created by the former developer; and
 
WHEREAS, the plat titled MEADOWS AT SHANNON LAKES SECTION ONE (hereinafter "plat"), has been submitted to the City Engineer's Office for approval and acceptance; and
 
WHEREAS, MARONDA HOMES INC. OF OHIO, an Ohio corporation, by JAMES F. BAUER, Executive Vice President, owner of the platted land, desires to dedicate to the public use all or such parts of the Boulevard, Court, Drives, Lane Street, Road and Way shown on said plat; and
 
WHEREAS, after examination, it has been found to be in the best interest of the City to accept said plat; now, therefore
 
WHEREAS,  an emergency exists in the usual daily operation in the City of Columbus in that it is immediately necessary that the Meadows at Shannon Lakes Section One from Maronda Homes Inc. of Ohio plat approval be amended to emergency because construction of the public improvement is ahead of schedule for for the immediate preservation of the public peace, property, health and safety; now therefore:
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.      That Ordinance Number 0792-03, acceptance of the plat titled TOWN SQUARE VILLAGES AT SHANNON ROAD SECTION 1, passed on the 9th day of June, 2003, is hereby repealed.
 
Section 2.      That the plat titled MEADOWS AT SHANNON LAKES SECTION ONE on file in the office of the City Engineer, Transportation Division, be and the same is hereby accepted.
 
Section 3.  That this ordinance shall take effect and be in force from and after the
earliest period allowed by law.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or 10 days after its passage if the Mayor neither approves nor vetoes the same.
