APPLICANT:  Village Communities Corporation; c/o Jeffrey L. Brown, Atty.; Smith and Hale; 37 West Broad Street; Columbus, Ohio 43215.
      
PROPOSED USE:  Multi-family residential development.
 
DEVELOPMENT COMMISSION RECOMMENDATION:  Approval (5-0) on June 10, 2004.
 
CITY DEPARTMENTS' RECOMMENDATION:  Approval.  The requested L-AR-12, Limited Apartment Residential District would allow a 100-unit multi-family development at a density of 10.19 units/acre.  The limitation text addresses buffering and screening for the adjacent single-family subdivision, landscaping, and commits to a water/entrance feature and pedestrian access to the park to the south.   Because a school was never developed on the site, the Far North Plan
(1994) recommendation that the site be developed with a school and other community uses no longer applies.   The requested L-AR-12, Limited Apartment Residential District is consistent with the zoning and development patterns of the area.

Body
 
WHEREAS, application #Z04-031 is on file with the Building Services Division of the Department of Development requesting rezoning of 9.81± acres from R, Rural District, to L-AR-12, Limited Apartment Residential District; and
 
WHEREAS, the Development Commission recommends approval of said zoning change; and
 
WHEREAS,  an emergency exists in the usual daily operation in the City of Columbus in that it is immediately necessary to begin construction as soon as possible for the immediate preservation of the public peace, property, health and safety; and
 
WHEREAS, the City Departments recommend approval of said zoning change because the requested L-AR-12, Limited Apartment Residential District would allow a 100-unit multi-family development at a density of 10.19 units/acre.  The limitation text addresses buffering and screening for the adjacent single-family subdivision, landscaping, and commits to a water/entrance feature and pedestrian access to the park to the south.   Because a school was never developed on the site, the Far North Plan (1994) recommendation that the site be developed with a school and other community uses no longer applies.   The requested L-AR-12, Limited Apartment Residential District is consistent with the zoning and development patterns of the area, now, therefore:    
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Official Zoning Map of the City of Columbus, as adopted by Ordinance No. 0179 -03, passed February 24, 2003, and as subsequently amended, is hereby revised by changing the zoning of the property as follows:

Situate in the State of Ohio, County of Franklin, City of Columbus, being located in part of Farm Lot 10 of Section 1, Township 2, Range 18, United States Military Lands, being all of a 9.814 acre tract as described in deed to The Board of Education of the Worthington City School District by Instrument Number 199906080144683 and being bounded and described as follows:
 
COMMENCE at a concrete monument, being known as FCGS 4451, found in the centerline of Lazelle Road, said point also being the northwest corner of Worthington Crossing Subdivision Section 1 recorded in Plat Book 83, Page 61 and also the northeast corner of a 1.194 acre tract described in deed to City of Columbus by Official Record Volume 08559, Page H19;
 
Thence, South 03°48'21" West, with the westerly line of said Worthington Crossing Section 1 and the east line of said 1.194 acre tract, a distance of 40.00 feet to a 5/8" iron pin set at the southeast corner of said 1.194 acre tract and the TRUE POINT OF BEGINNING, herein;

SECTION 2.  That a Height District of thirty-five (35) feet is hereby established on the L-AR-12, Limited Apartment Residential District on this property.
 
SECTION 3.  That the Director of the Department of Development be, and he is hereby authorized and directed to make the said changes on the said original zoning map in the office of the Building Services Division and shall register a copy of the approved L-AR-12, Limited Apartment Residential District and Application among the records of the Building Services Division as required by Section 3370.03 of the Columbus City Codes; said plan being titled "PRELIMINARY DEVELOPMENT PLAN", said text being titled "LIMITATION TEXT", both signed by Jeffrey L. 1.  INTRODUCTION:   The site is located on the south side of Lazelle Road between a landscaping business and a single family subdivision.  There is a city park adjacent to the south property line while multi-family development is located on the north side of Lazelle Road.
 
2. PERMITTED USES: Those uses permitted in Section 3333.02, AR-12 of the Columbus City Code.
 
3. DEVELOPMENT STANDARDS: Unless otherwise indicated, the applicable development standards are contained in Chapter 3333 of the Columbus City Code.  
 
A.  Density, Lot, and/or Setback Commitments.  
 
1.  The maximum number of units shall be 100.
 
2.  The building setback from the east property line shall be 225 feet.
 
B.  Access, Loading, Parking, and/or Other Traffic Related Commitments.
 
1.  The developer shall install a west bound left turn lane on Lazelle road at its access point subject to the review and approval of the City's Division of Transportation.
 
2.  The developer shall install at least 20 more parking spaces than required by the zoning code.
 
C.   Buffering, Landscaping, Open Space, and/or Screening Commitments.
 
1.  The developer shall install street trees 30 feet on center within the setback along Lazelle Road, the west and south property lines except as noted in item 2 below.  The trees may be located within the right-of-way of Lazelle Road if approved by the city forester.  The developer shall also install a white three rail fence within the setback along Lazelle Road except at the access point.
 
2.  The eastern portion of the site shall be developed and landscaped in accordance with the submitted site plan.  The balance of the site plan is conceptual and will not be committed to in this zoning.
 
3.  The eastern portion of the Subject Site shall be developed and landscaped in accordance with the submitted site plan.  The site plan may be slightly adjusted to reflect engineering, topographical or other site data developed at the time of development or when engineering plans are completed.  Any slight adjustment to the plan shall be reviewed and may be approved by the Director of the Department of  Development or his/her designee upon submission of the appropriate data regarding the proposed adjustment.
 
4.  All trees and landscaping shall be well maintained.  Dead materials shall be replaced within six (6) months or the next planting season, whichever occurs first.  All trees shall meet the following minimum size at the time of planting:
 
Shade trees 2 ½" caliper; Ornamental trees 1 1/2" caliper; Evergreen trees 5 feet in height.  Tree caliper is measured six
(6) inches from the ground.
 
D.  Building Design and/or Interior-Exterior Treatment Commitments.
 
The east elevation of the first building and garage as shown on the submitted site plan shall be finished in brick.
 
E.  Lighting, Outdoor Display Areas, and/or other Environmental Commitments.
 
1.  Light fixtures shall not exceed 18 feet.
 
F.  Graphics and/or Signage Commitments.

G.  Miscellaneous Commitments.
 
1.  The developer shall install a path connecting a paved portion of the site to the park's property line.
 
2.  The developer shall install a sidewalk along its entire Lazelle Road frontage except at the access point.
 
3.  The developer shall comply with the City's parkland dedication ordinance by making a cash contribution to the City of Columbus of $62,089.50 at the time of zoning clearance.
 
SECTION 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or 10 days after its passage if the Mayor neither approves nor vetoes the same.
