Explanation

 

Background:  This ordinance authorizes the Director of the Recreation and Parks Department to modify the contract with Burgess & Niple, Inc. for additional services to prepare plans, specifications, bidding documents and VAP documentation for the remediation of the contaminated soil at Saunders Park.  It will be more time efficient and cost effective to keep the current engineering team in place, so that we can move forward as quickly as possible.

 

Burgess and Niple, Inc. was originally contracted by the City in 2013, Ordinance 2128-2013, contract amount of $142,000.00 for services to prepare plans, specifications, bidding docs and VAP reporting/documentation for the remediation of the soils in Saunders Park.  A second modification to that contract took place in Oct. 2014, Ordinance No. 2343-2014; contract amount of $289,000.00.  This allowed for additional services to be added including engineering, project oversight/management, OEPA coordination and additional VAP reporting and documentation.  In an effort to keep the project moving forward, Burgess and Niple, Inc. expanded their scope of services to provide additional design, bid package material, engineering services during construction, providing information for the City Attorney’s Office for OEPA, Hexion and USEPA and No Further Action review information. 

 

The modification will increase the current cost of the project of $451,000.00 by adding $80,000.00 for a new project total of $531,000.00.

Emergency Justification: An emergency is being requested so that work may not be interrupted and can continue on the current project.

 

Benefits to the Public: The project and additional work required has help to eliminate safety concerns that were discovered.  The completed project will allow sports leagues to utilize the fields once fenced off to the public.

Master Plan Relation:  This work continues to address a park that is heavily used by the community.  It addresses safety concerns that were discovered.   

 

Fiscal Impact: The expenditure of $142,000.00 was legislated for the Saunders Park Project by Ordinance 2128-2013. A modification was authorized by Ordinance 2343-2014, adding an additional $309,000.00 to the project total. This ordinance will provide funding that will modify the previously authorized amount by $80,000.00.  $80,000.00 is budgeted and available in the Recreation and Parks Voted Bond Fund 7702 to meet the financial obligations of this contract modification. The aggregate total amount authorized, including this modification, is $531,000.00.

To authorize the Director of Recreation and Parks to modify the contract with Burgess & Niple, Inc. for additional services to prepare plans, specifications, bidding documents and VAP documentation for the remediation of the contaminated soil at Saunders Park; to authorize the City Auditor to appropriate, transfer, and expend $80,000.00 between projects within Recreation and Parks Bond Fund; to amend the 2017 Capital Improvements Budget Ordinance 1124-2017; and to declare an emergency. Body

 

WHEREAS, it is necessary to authorize and direct the Director of Recreation and Parks to modify the contract with Burgess & Niple, Inc. for additional services to prepare plans, specifications, bidding documents and VAP documentation for the remediation of the contaminated soil at Saunders; and

 

WHEREAS, it is necessary to authorize that the 2017 Capital Improvements Budget Ordinance 1124-2017 be amended in order to provide sufficient budget authority for this legislation and future projects; and

 

WHEREAS, it is necessary to authorize the expenditure of $80,000.00 from the Recreation and Parks Voted Bond Fund 7702; and

 

WHEREAS, an emergency exists in the usual daily operation of the the Recreation and Parks Department in that it is immediately necessary to authorize the Director to modify the contract with Burgess & Niple, Inc. so that work may not be interrupted and can continue on the current project; NOW, THEREFORE

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the Director of Recreation and Parks is hereby authorized to modify the contract with Burgess & Niple, Inc. for additional services to prepare plans, specifications, bidding documents and VAP documentation for the remediation of the contaminated soil at Saunders Park.

 

SECTION 2. That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 3. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

SECTION 4. That the City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project.

 

SECTION 5. That the transfer of $80,000.00 or so much thereof as may be needed, is hereby authorized between projects within the Recreation and Parks Voted Bond Fund 7702 per the account codes in the attachments to this ordinance.

 

SECTION 6. That the 2017 Capital Improvements Budget Ordinance 1124-2017 is hereby amended as follows in order to provide sufficient budget authority for this legislation and future projects.

SECTION 7. That for the purpose stated in Section 1, the expenditure of $80,000.00 or so much thereof as may be necessary to pay the cost thereof, be and is hereby authorized from the Recreation and Parks Voted Bond Fund in object class 06 Capital Outlay per the accounting codes in the attachment. 

 

SECTION 8.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or 10 days after passage if the Mayor neither approves nor vetoes the same.
