APPLICANT:  The New Albany Company; c/o Jeffrey L. Brown, Atty.; Smith and Hale; 37 West Broad Street, Suite 725; Columbus, OH 43215.
 
PROPOSED USE:  Multi-family residential development with fewer than 3-units per dwelling.                                                        
                                                                                
CITY DEPARTMENTS' RECOMMENDATION:  Approval.  A Council variance is necessary in that the L-ARO, Limited Apartment Office District does not allow more than one two-unit, three-unit or four-unit dwellings on a parcel.  The applicant also requests technical variances including a perimeter yard reduction for internal property lines and to permit one and one-half story buildings where a minimum of two stories is required.

To grant a variance from the provisions of Sections 3333.04, Permitted Uses, 3333.22 Maximum Side Yard, 3333.23 Minimum Side Yard, 3333.24 Rear Yard, 3370.6 Standards and 3370.07 Conditions and Limitation, of the Columbus City Codes for the property at 6037 CENTRAL COLLEGE ROAD (43054) to permit a multiple dwelling development of one story and one and one-half story two-, three- and four-unit buildings with no internal perimeter yard in the L-AR-O Limited Apartment Office District and to declare an emergency. WHEREAS, by application #CV05-048 the owner of property at 6037 CENTRAL COLLEGE ROAD (43054) is requesting a Council Variance to permit a multiple dwelling development of one story and one and one-half story two, three and four unit dwellings with no internal perimeter yard in the L-AR-O Limited Apartment Office District; and
 
      WHEREAS, Section 3333.04, Permitted Uses, does not permit two-unit dwellings and requires that three- and four-unit dwellings be developed in accordance with R-4 standards which does not permit multiple dwelling development, while the applicant wishes to construct more than one two, three and four-unit dwellings on the parcel which could be considered a multiple dwelling development which will not conform to the standards of the R-4, Residential District; and
 
              WHEREAS,  an emergency exists in the usual daily operation in the City of Columbus in that it is immediately necessary to pass this ordinance to begin construction as soon as possible for the immediate preservation of the public peace, property, health and safety; and
 
               WHEREAS, Sections 3333.22, Maximum Side Yard, 3333.23, Minimum Side Yard, and 3333.24, Rear Yard, permits a perimeter yard to meet the maximum and minimum side yard requirement and rear yard requirement for an apartment complex or multiple dwelling development only, while the applicant does not wish to provide a perimeter yard along the common property line between the parcels which comprise this proposed development; and
 
      WHEREAS, Section 3370.6, Standards, requires any use to meet or exceed each minimum development standard of the underlying zoning classification unless more limited standards are specifically identified in the limited overlay development plan in which event such more limited standards shall apply, while the applicant does not wish to comply with some of the standards of the underlying AR-O, Apartment Office District or some of the limitations contained in the limitation text of Z95-102; and
 
      WHEREAS, Sections 3370.07, Conditions and Limitations, requires any use to conform to each condition or limitation specifically identified and imposed in the development plan, while the applicant does not wish to comply with the zoning text requirement in Z95-102 that requires all buildings to be at least two stories and not more than three stories in height; and
 
      WHEREAS, the limited overlay text in Z95-102 does not permit one-story or one and one-half story two, three and four-unit dwellings as a multi-family development with no internal perimeter yard; and
 
      WHEREAS, the City Department's note that a hardship exists in that the existing zoning classification does not permit a multiple dwelling development of one- story and one and one half story two, three and four-unit dwellings with no internal perimeter yard in the L-AR-O;
 
      WHEREAS, said variance will not adversely affect the surrounding property or surrounding neighborhood;
 
      WHEREAS, the granting of said variance will not impair an adequate supply of light and air to adjacent properties or unreasonably increase the congestion of public streets, or unreasonably diminish or impair established property values within the surrounding areas, or otherwise impair the public health, safety, comfort, morals, or welfare of the inhabitants of the City of Columbus; and
 
      WHEREAS, the granting of said variance will alleviate the difficulties encountered by the property owner located at 6037 CENTRAL COLLEGE ROAD (43054) in using said property as desired; now therefore;
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS
 
      Section 1.  That a variance from Sections 3333.04 Permitted Uses, 3333.22 Maximum Side Yard, 3333.23 Minimum Side Yard, 3333.24 Rear Yard 3370.6 Standards and 3370.04 Conditions and Limitations of the Columbus City Codes are hereby granted for the property located at 6037 CENTRAL COLLEGE ROAD (43054),  to permit a multiple dwelling development with one-story and one and one-half story two-, three and four-unit dwellings not in accordance with the R-4 standards which meets the perimeter yard requirement for its side and rear yards except that there is no perimeter yard between the internal tax parcel lines of the development, said property being more particularly described as follows:

      Bearings are based on the Ohio State Plane Coordinate System as per NAD 83 (1986 Adjustment).  Control for bearings was from coordinates of monuments Frank 5574 and Frank 5113, with a portion of Central College Road having a bearing of South 86 deg. 09' 36" East, established by the Franklin County Engineering Department, using Global Positioning System procedures and equipment.
      
Section 2.  That this ordinance is conditional on and shall remain in effect only for so long as said property is used for a multiple dwelling development of two, three, and four-unit dwellings of one-story and one and one-half stories in height or those uses in the L-AR-O, Limited Apartment Office District.
 
      Section 3.  That a maximum of 350 dwelling units shall be permitted on said property.
 
      Section 4.  That this ordinance is further conditioned on the applicant obtaining all applicable permits and a Certificate of Occupancy for the proposed use.
 
      Section 5.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or 10 days after its passage if the Mayor neither approves nor vetoes the same.
