Explanation
 
BACKGROUND: For the Purchase of a Total Organic Carbon analyzer (TOC) for the Division of Power and Water. This equipment will be used in the water quality management of the supply by the Water Quality Assurance Laboratory.  The Purchasing Office opened formal bids on May 24, 2007.
 
The Purchasing Office advertised and solicited competitive bids in accordance with Section 329.06 (Solicitation No. SA002422) Fifteen (15) bids were solicited; Two (2) bids were received. The Division of Power and Water recommends that the bid be awarded to the lowest, responsible, and responsive bidder.  Hach Company, the lowest numerical bid was deemed non-responsive to section 3.3.3.  which requires the instrument must use UV, persulfate and heat.  Their analyzer only uses UV and persulfate not heat. 3.3.3.16 which requires Analyzer must offer automatic reduction of sample injection volume for over range samples.  Their analyzer does not offer the capability to do auto dilutions.3.3.4.2 which requires The detection limit must be 0.5 ppb to 3,500 ppb.  Their instrument only goes down to 20 ppb. 3.3.7.2 which requires Software must have control chart software.  Their IL 500 software contains no provisions for QC control charts.  6.2.2 which requires Contractor must have dedicated service rep. within 150 miles and they do not have dedicated service reps.
 
Shimadzu Scientific Company, CC#521035956 (expires 4/19/2009).
The award is for one unit at a cost of $28,358.85.  Terms and conditions were included in the bid; however the company has agreed to rescind the terms and conditions and accept the City of Columbus terms and conditions.
 
This company is not debarred according to the Federal Excluded Parties Listing or the State Auditor's Findings For Recovery Database.
 
Fiscal Impact:  The Division of Power and Water budgeted $40,000.00 for this purchase.  Sufficient funds remain in the division to contract for purchase.

WHEREAS, the Purchasing Office opened formal bids on May 24, 2007 for the purchase of a Total Organic Carbon Analyzer (TOC) for the Division of Power and Water, and
 
WHEREAS, the Division of Power and Water recommends an award be made to the lowest, responsive, and responsible bidder, Shimadzu Scientific Company and,
 
WHEREAS, this equipment will be used in the management water quality of the water supply by the Water Quality Assurance Laboratory, and
 
WHEREAS, a contract will be issued in accordance with the terms, conditions and specifications of Solicitation  SA002422 on file in the Purchasing Office; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1. That the Director of Finance and Management be and is hereby authorized to establish a contract with Shimadzu Scientific Company for the purchase of a Total Organic Carbon Analyzer (TOC) for the Division of Power and Water, in accordance with specifications on file in the Purchasing Office.
 
Section 2. That the expenditure of $28,358.85 or so much thereof as may be needed, be and the same hereby is authorized from the Water System Operating Fund, Fund No. 600, OCA 601989, Object Level 1: 06, Object Level 03: 6697.
 
Section 3. That this Ordinance shall take effect and be in force from and after the earliest period allowed by law.
