Rezoning Application Z24-079

 

APPLICANT:  Robert Ellis; 485 Brickell Avenue, #2303; Miami, FL 33101.

 

PROPOSED USE:  Three-unit dwelling.

 

DEVELOPMENT COMMISSION RECOMMENDATION: Approval (6-0) on February 13, 2025.

 

LIVINGSTON AVENUE AREA COMMISSION RECOMMENDATION: Approval.

 

CITY DEPARTMENTS' RECOMMENDATION:  Approval. The 0.12± acre site consists of one undeveloped parcel in the R-2F, Residential District. The requested R-4, Residential District will allow up to a four-unit dwelling at this location. The site is located within the planning boundaries of the Near Southside Area Plan (2011), which recommends “Medium Density Mixed Residential” land uses, consistent with the uses allowed in the requested R-4 district. Additionally, the request does not introduce incompatible uses to the area. A concurrent Council variance (Ordinance #0555-2025; CV24-170) is also being considered for required parking, vision clearance, lot width, and lot area.

WHEREAS, application #Z24-079 is on file with the Department of Building and Zoning Services requesting rezoning of 0.12± acres from R-2F, Residential District, to R-4, Residential District; and

 

WHEREAS, the Development Commission recommends approval of said zoning change; and

 

WHEREAS, the Livingston Avenue Area Commission recommends approval of said zoning change; and

 

WHEREAS, the City Departments recommend approval of said zoning change because the requested R-4, Residential District is consistent with the land use recommendations of the Near Southside Area Plan, and does not introduce an incompatible use to the area; now, therefore:

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the Official Zoning Map of the City of Columbus, as adopted by Ordinance No. 0179 -03, passed February 24, 2003, and as subsequently amended, is hereby revised by changing the zoning of the property as follows:

 

798 SEYMOUR AVE. (43205), being 0.12± acres located at the northeast corner of Seymour Avenue and Gault Street, and being more particularly described as follows:

 

Situated in the County of Franklin, in the State of Ohio and in the City of Columbus:

Being Lot Numbered Fifty-eight (58) of M. K. English's Seymour Avenue Subdivision, as the same is numbered and delineated upon the recorded plat thereof, of record in Plat Book 12, page 14, Recorder's Office, Franklin County, Ohio. .

To Rezone From: R-2F, Residential District,

 

To:  R-4, Residential District.

 

SECTION 2.  That a Height District of thirty-five (35) feet is hereby established on the R-4, Residential District on this property.

 

SECTION 3.  That the Director of the Department of Building and Zoning Services be, and is hereby authorized and directed to make the said changes on the said official zoning map in the office of the Department of Building and Zoning Services.

 

SECTION 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
