Explanation
Background:  The Fleet Management Division discovered a leak in an underground fuel line at the Short Street fuel facility in December 2005.  Because the leak was underground, and because there were previous underground fuel tank leaks at the Short Street fuel island, the State of Ohio Bureau of Underground Storage Tank Regulations (BUSTR) required a Tier I assessment of the entire fuel island site.  Following an informal bid process, the Fleet Management Division entered into contract with Resource International, Inc. (Rii) for the Tier I assessment, which was completed in December 2006.   Due to the test results of the Tier I assessment, BUSTR requires a Tier I Delineation.   A second assessment (Tier I Delineation) should be completed by the same firm that conducted the original Tier I assessment; therefore, the Fleet Management Division is requesting waiver of competitive bids to have Resource International conduct the Tier I Delineation.  Rii was selected for the original Tier I assessment as the lowest and best bid based upon informal quotes received in 2006.  (The other quotes were submitted by Burgess & Niple and ATS Chester).  
 
Fiscal Impact:  This ordinance authorizes the Director of Finance and Management to enter into a contract with Resource International Inc., for a Tier I Delineation of the Short Street fuel location.  The Fleet Management Division budgeted $25,000.00 for this assessment in the 2007 operating budget.  Rii has agreed to complete this assessment for an amount of up to $21,940.00.  
 
Resource International, Inc. Contract Compliance Number 31-0669793,expiration date 07/29/2008.  This firm is a certified female business enterprise (FBE).
 
Emergency action is being requested so that the Tier I Delineation can be completed and the Fleet Management Division can respond to BUSTR by July 2007.

Body
 
WHEREAS, the Fleet Management Division discovered a leak in an underground fuel line at the Short Street fuel island in December 2005; and
 
WHEREAS, the Bureau of Underground Storage Tank Regulations (BUSTR) required a Tier I assessment of the site; and
 
WHEREAS, Resource International, Inc. completed the Tier I assessment and BUSTR is now requiring that a Tier I Delineation be completed by July 2007; and
 
WHEREAS, a Tier I Delineation should be completed by the same firm that conducted the original Tier I site assessment, and
 
WHEREAS, it is in the best interest of the City of Columbus to waive the competitive biding requirements of of the Columbus City Codes, and
 
WHEREAS, Resource International, Inc. has agreed to provide the Tier I Delineation services for an amount of up to $21,940.00, and
WHEREAS, an emergency exists in the usual daily operation of the Finance and Management Department, Fleet Management Division, in that it is immediately necessary to authorize the Finance and Management Director to enter into a contract with Resource International, Inc., to complete a Tier I Delineation and comply with BUSTR regulations by July 2007, thereby preserving the public health, peace, property, safety and welfare; now, therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY COLUMBUS:
 
SECTION 1.  That the Finance and Management Director be and hereby is authorized to enter into a contract with Resource International, Incorporated, 6350 Presidential Gateway, Columbus, Ohio 43231, for a Tier I Delineation of the Short Street fuel island area.  
 
SECTION 2.  That the sum of $21,940.00, or so much thereof as may be needed, is hereby authorized to be expended from the Fleet Management Services Fund 513, Department 45-05, Object Level One Code 03, Object Level Three Code 3336 and OCA Code 451206 to pay the cost thereof.
 
SECTION 3. That the Council finds it in the best interest of the City of Columbus to waive requirements of competitive bidding for a Tier 1 Delineation of an underground fuel leak at the Short Street fuel facility and does hereby waive provisions of Section 329.11 of the Columbus City Codes.
 
SECTION 4.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
