Title: To authorize the Director of Public Service to enter into a professional engineering service contract with Prime Engineering, Inc, for the Arterial Street Rehabilitation - Alum Creek Drive - Frebis to Refugee project; to amend the 2012 C.I.B; to authorize the transfer of funds within the Streets and Highways G.O. Explanation
1.  BACKGROUND:
This legislation authorizes the Director of Public Service to enter into a professional engineering services contract with Prime Engineering, Inc, for the Arterial Street Rehabilitation - Alum Creek Drive - Frebis to Refugee project.   
 
This project involves preliminary and final engineering for improvements to Alum Creek Drive from Performance Way/Refugee Road South to Frebis Avenue/Integrity Drive South.  Design will proceed in two parts with part 1 consisting of preliminary engineering to determine the roadway and intersection capacity needs, to provide an updated grade separation assessment relative to the Alum Creek Drive crossing of Norfolk-Southern railroad tracks, and to determine the improvements needed to the bridge over and interchange with SR-104 to accommodate pedestrian/bikeway improvements on Alum Creek Drive.
 
The specific scope of work for Part 2 will be developed upon completion of Part 1 but will generally consist of the remaining preliminary engineering, environmental engineering, and final engineering. The project will receive funding from MORPC for the Part 2 design, acquisition, utility reimbursement, and construction.
26 ADA ramps will be added or reconstructed in this project.  There are 7 bus stops and transit routes within the limits of this project.  The Ohio Department of Transportation designation for this project is FRA-CR122-6.220 (PID 85017)
The Department of Public Service, Office of Support Services solicited Requests for Proposals for the Arterial Street Rehabilitation - Alum Creek Drive - Frebis to Refugee contract.  The project was formally advertised on the Vendor Services web site from January 30, 2012 to February 27, 2012.  The city received four (4) responses.  All proposals were deemed minimally compliant and were fully evaluated when the Evaluation Committee met on February 29, 2012.

Prime Engineering, Inc. received the highest score by the evaluation committee and will be awarded the Arterial Street Rehabilitation - Alum Creek Drive - Frebis to Refugee contract in an amount up to $319,870.47.
Searches in the Excluded Party List System (Federal) and the Findings for Recovery list (State) produced no findings against Prime Engineering, Inc.
 
2.  FISCAL IMPACT
Part 1 of this contract will be $319,870.47.  Part 2 of this contract is estimated to be $1,600,000.00 of which $1,280,000.00 is provided by MORPC funding. This contract will estimate costs for construction, acquisition, utility reimbursement, and inspection.  Funding for part 1 is available within the Streets and Highways G.O. Bonds Fund.  A C.I.B. amendment is necessary to establish authority in the correct project detail.
3. CONTRACT COMPLIANCE
The contract compliance number for Prime Engineering, Inc., is 341134715 and Expires 3/1/13.
4.  PLANNED CONTRACT MODIFICATION
This ordinance authorizes funding for part 1 of this design contract.  A planned modification will be executed at the completion of part 1 to add additional funding.
5.  EMERGENCY DESIGNATION
Emergency action is requested to provide funding for the professional services described above at the earliest possible time to provide for design work for this project at the earliest possible time.

WHEREAS, there is a need to provide professional engineering services for the design of the Arterial Street Rehabilitation - Alum Creek Drive - Frebis to Refugee project; and

WHEREAS, Prime Engineering, Inc, received the highest score by the evaluation committee and will be awarded the contract for this project; and
 
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service, in that this legislation should go forth immediately to provide funding for these engineering services to provide project design services for pedestrian and travelling public improvements at the earliest possible time, thereby preserving the public health, peace, property, safety and welfare; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Director of Public Service be and hereby is authorized to enter into a professional services contract with Prime Engineering, Inc, 3000 Corporate Exchange Drive, Suite 600, Columbus, OH, 43231, for engineering services associated with the Arterial Street Rehabilitation - Alum Creek Drive - Frebis to Refugee project.
SECTION 2.  That the 2012 Capital Improvement Budget established within ordinance 0368-2012 be and hereby is amended as follows:

SECTION 6.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the mayor, or ten days after passage if the mayor neither approves nor vetoes the same.
