Explanation

1. BACKGROUND

This ordinance authorizes the Director of Public Utilities to enter into a planned contract modification for professional engineering services agreement with Evans, Mechwart, Hambleton & Tilton, Inc. for the Franklinton Stormwater Improvements project, CIP #610910-100001, in an amount up to $900,921.03.

 

The Franklinton Area Stormwater System Improvements project was initiated to develop master planning and detailed design plans for constructing storm sewers and/or detention facilities to improve stormwater system capacity in the Franklinton Area.  The goal of this project is to mitigate street and structural flooding caused by insufficient capacity of the Renick Run storm sewer system, south of I-70 and north of Renick Run Pump Station. The project area is bounded on the north by I-670, south by Hart Rd, west by Wheatland Ave. and east by SR-315 and I-71 freeway.

The initial funding for this project prepared a detailed storm model of the West Franklinton neighborhood. Alternatives were proposed to resolve the flooding issues and, after extensive discussion with shareholders, a preferred alternative has been determined. This alternative has been approved by management and property acquisition has begun.

 

There a total of 3 phases of this project. Once all 3 phases are complete, the level of service of the storm sewer system in the West Franklinton neighborhood will handle rain events to avoid surcharges for:

•  The 2 year design storm on local streets and,

•  The 5 year design storm on arterial streets.

 

This phase, Phase 1, of the project, was to determine a solution to the flooding problem and design improvements to increase capacity downstream of West Franklinton.  The design improvements include a retention basin in McCoy Park and a large trunk sewer to the corner of Mound Street and Glenwood Avenue.  This contract modification will perform preliminary engineering and design to 30% completion.  An additional contract modification will be necessary to complete preliminary design.

 

The Community Planning Area for this project is 54 - Franklinton.

1.2. Reason other procurement processes are not used: 

This contract was awarded using the City’s RFP process with planned modifications to add funding to complete design.  This is one of the planned design funding modifications. 

 

1.3. How cost of modification was determined:

The consultant prepared a scope and cost per task based upon current contract job titles, pay rates, and allowable expenses.  The cost was then negotiated by the City Project Manager.

 

2. ECONOMIC IMPACT/ADVANTAGES; COMMUNITY OUTREACH; PROJECT DEVELOPMENT; ENVIRONMENTAL FACTORS/ADVANTAGES OF PROJECT 

This project will increase sewer system capacity for West Franklinton to handle:

•  The 2 year event on local streets and,

•  The 5 year rain event on arterial streets.

 

With additional capacity in the storm sewer system, maintenance, property damage, and travel will be improved in the study area.

 

3. CONTRACT COMPLIANCE INFORMATION 

Evans, Mechwart, Hambleton & Tilton, Inc.’s contract compliance number is CC004214 and expires 11/8/25.

 

4. MINORITY AND WOMAN OWNED BUSINESS ENTERPRISE & SMALL LOCAL BUSINESS ENTERPRISE PROGRAM

This contract was put in place prior to the implementation of the City of Columbus MBE/WBE Program and is not subject to the requirements of that program.  Evans, Mechwart, Hambleton & Tilton, Inc. is classified as a majority company by the City’s Office of Diversity and Inclusion.  Evans, Mechwart, Hambleton & Tilton, Inc. anticipates performing the work on this contract modification with the use of three sub-consultants. The MBE/WBE percentage for this contract modification is expected to be 37.4%.

 

As part of their proposal, Evans, Mechwart, Hambleton & Tilton, Inc.  has proposed the following sub-consultants to perform contract work:

The certification of Evans, Mechwart, Hambleton & Tilton, Inc. and the above companies was in good standing at the time the bid was awarded.

 

 5.  FISCAL IMPACT

An amendment to the 2024 Capital Improvement Budget is needed to align budget authority with the proper projects.  A transfer of cash and appropriation between projects within the Storm Sewer Bond Fund, Fund 6204, is needed to align cash and appropriation with the proper projects.

WHEREAS, the Department of Public Utilities is engaged in the Franklinton Stormwater Improvements Project; and

 

WHEREAS, Contract No. PO185019 was authorized by Ordinance No. 1470-2019, for the Franklinton Stormwater Improvements Project; and

 

WHEREAS, this contract modification is a planned modification to add funding for the start of detailed design; and

 

WHEREAS, it is necessary for Council to authorize the Director of Public Utilities to modify the professional engineering services agreement with Evans, Mechwart, Hambleton & Tilton, Inc.  for the Franklinton Stormwater Improvements Project to add funds to the contract; and

 

WHEREAS, an amendment to the 2024 Capital Improvement Budget is needed to align budget authority with the proper project; and

 

WHEREAS, it is necessary to transfer cash and appropriation within the Storm Sewer Bond Fund, Fund 6204, to  align cash and appropriation with the proper project; and

 

WHEREAS, it is necessary to expend funds from the Storm Sewer Bond Fund, Fund 6204 to pay for the contract modification; now, therefore,

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the 2024 Capital Improvement Budget authorized by Ordinance 1907-2024 be amended as follows to establish sufficient budget authority for this project:

SECTION 2. That the transfer of $900,921.03, or so much thereof as may be needed, is hereby authorized between projects within the Storm Sewer Bond Fund, Fund 6204, per the account codes in the attachment to this ordinance.

 

SECTION 3.  That the Director of Public Utilities is hereby authorized to modify and increase the professional engineering services contract with Evans, Mechwart, Hambleton & Tilton, Inc., 5500 New Albany Road, Columbus, Ohio 43054 for the Franklinton Stormwater Improvements project, in an amount up to $900,921.03.

 

SECTION 4.  That an expenditure of $900,921.03, or so much thereof as may be needed, is hereby authorized from the Storm Sewer Bond Fund, Fund 6204, to pay for this contract modification per the accounting codes in the attachment to this ordinance.

 

SECTION 5.  Funds are hereby deemed appropriated and expenditures and transfers authorized to carry out the purposes of this ordinance and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 6.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

SECTION 7.  That the City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project.

 

SECTION 8.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
