Explanation
BACKGROUND: The Franklin County Municipal Court Judges entered into a contract with Asist Translation Services, Inc. effective February 1, 2005, for the fourth year of a four-year contract to provide language interpreter services to the Court under the authority of ordinance number 0185-2005 passed by City Council on February 7, 2005. On December 11, 2005 a sixty-day extension of the contract was passed by City Council (ordinance number 2131-2005) in order to permit the Court time to draft specifications for the re-bid of language interpreter services. The Court needs more time to complete the specification drafting and bid processes. In addition, one of the Court's in-house interpreters retired, necessitating the provision, under the contract for language interpreter services, for potential long-term and telephone interpreter assignments. Provisions to extend this contract were contemplated in the original contract.
This legislation authorizes the Administrative and Presiding Judge of the Franklin County Municipal Court to modify and extend the contract with Asist Translation Services through November 30, 2006.

FISCAL IMPACT: Funds for this contract are budgeted and available within the Municipal Court Judges 2006 general fund appropriations. During 2005, the Court expended $105,217.50 with Asist; during 2004, the Court expended $99,860.00.
EMERGENCY: This ordinance is submitted as an emergency to allow the financial transaction to be posted in the city's accounting system as soon as possible. Up-to-date financial posting promotes accurate accounting and financial management.

To authorize the Administrative and Presiding Judge of the Franklin County Municipal Court to modify and extend the contract with Asist Translation Services, Inc. for language interpreter services for the Franklin County Municipal Court Judges; to authorize the expenditure of an amount not to exceed $75,000; and to declare an emergency. WHEREAS, contract number EL005216 with Asist Translation Services, Inc. effective February 1, 2005, was authorized by ordinance number 0185-2005 that passed February 7, 2005 and extended for 60 days through March 31, 2006 by ordinance number 2131-2005 that passed on December 11,2005; and
WHEREAS, it is necessary to modify the original contract to provide for a further extension through November 30, 2006 to complete the specification writing and bidding processes; and
WHEREAS, it is further necessary to modify the original contract to provide for the potential of long-term and telephone interpreter assignments; and
WHEREAS, an emergency exists in the usual daily operation of the city, in that it is immediately necessary to authorize the Administrative and Presiding Judge of the Franklin County Municipal Court to modify and extend the contract and authorize the expenditure with Asist Translation Services, Inc. for provision of language interpreter services, thereby preserving the public health, peace, property, safety and welfare, Now, Therefore;
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the Administrative and Presiding Judge of the Franklin County Municipal Court be and is hereby authorized to modify and extend a contract with Asist Translation Services, Inc. for language interpreter services to the Franklin County Municipal Court Judges to provide for an extension of the contract term through November 30, 2006 and to allow for long-term interpreter assignments.
Section 2. That the expenditure of $75,000, or as much thereof as may be necessary is hereby authorized from the Franklin County Municipal Court Judges, department number 2501, general fund, fund number 010, oca 250191 , object level 1 - 03, object level 3 - 3445.
Section 3. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
