Title: To authorize the expenditure of $25,000.00 or so much thereof as may be necessary from the 1995, 1999, 2004 Voted Streets and Highways Fund for right-of-way acquisition costs relative to the Minnesota Avenue Improvement Project; to authorize the City Attorney's Office, Real Estate Division, to expend these funds to complete right-of-way acquisition for this project; and to declare an emergency. Explanation
 
The City of Columbus is engaged in the acquisition of temporary construction easements for the Minnesota Avenue Improvement project.  The purpose of this project is to reconstruct and widen (to 26 feet in width) an existing uncurbed two-lane road from Joyce Avenue to Parkwood Avenue.  New sidewalks, curb and gutter will be installed as a part of this project.  Initial acquisition funding for this project, in the amount of $76,000.00, was taken from the 1995, 1999 Voted Streets and Highway Fund.  Expenditure of these funds was authorized pursuant to Ordinance 0386-2005, passed March 23, 2005.  The City Attorney's Office, Real Estate Division, has requested an additional $25,000.00 to complete acquisition of the temporary easements needed for this project.
 
Fiscal Impact: Funding for this project in the amount of $25,000.00 is budgeted and available in the 1995, 1999, 2004 Voted Streets and Highways Fund.
 
Emergency Justification: Construction plans for this improvement project are complete and fully signed.  Construction of this improvement project is contingent upon completion of the right-of-way acquisition.  Emergency action is being requested so the City Attorney's Real Estate Division can complete right-of-way acquisition this year.

WHEREAS, the purpose of this project is to reconstruct and widen (to 26 feet in width) an existing uncurbed two lane road from Joyce Avenue to Parkwood Avenue; and
 
WHEREAS, new sidewalks, curb and gutter will be installed as a part of this project; and
 
WHEREAS, initial acquisition funding for this project, in the amount of $76,000.00, was taken from the 1995, 1999 Voted Streets and Highway Fund; and
 
WHEREAS, expenditure of these funds by the City Attorney's Office, Real Estate Division, was authorized pursuant to Ordinance 0386-2005, passed March 23, 2005; and
 
WHEREAS, the City Attorney's Office, Real Estate Division, has requested an additional $25,000.00 to complete acquisition of the temporary construction easements needed for this project; and
 
WHEREAS, because the construction plans for this roadway improvement project have been completed and signed construction of this project can begin upon completion of the right-of-way acquisition; and
 
WHEREAS, an emergency exists in the usual daily operation of the Public Service Department, Transportation Division, in that it is immediately necessary to authorize the City Attorney's Office, Real Estate Division, to expend the additional funds necessary to complete acquisition of the rights-of-way needed for the Minnesota Avenue Improvement project for the preservation of the public health, peace, property, safety and welfare; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the City Attorney's Office, Real Estate Division, be and is hereby authorized to expend those funds necessary to complete acquisition of the temporary construction easements needed for the Minnesota Avenue Improvement project.
 
SECTION 2.  That for the purpose of paying said costs the City Attorney's Office, Real Estate Division, is hereby authorized to expend an additional $25,000.00, or so much thereof as may be necessary from fund 704, the 1995, 1999, 2004 Voted Streets and Highways Fund; Department/Division 59-09; Minor Object 6601; Project 530161(Roadway Improvements), OCA Code 644385.
 
SECTION 3.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
 
SECTION 4.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
