Explanation
 
Background:  On August 22, 2006 the Department of Recreation and Parks received and opened one (1) bid for food services at Turnberry Golf Course.  The recommendation was made to award the revenue generating contract, CT01132R, to En-Course Catering, Inc. for a term of three (3) years with the option to renew annually for an additional two (2) years.
 
The original contract would have generated $202,000 in revenue over five (5) years.  This legislation will authorize a modification between the City and the Concessionaire resulting in a $7,000 decrease in total annual revenue payments for 2009, 2010 and 2011.  The total revenue generated at the end of the contract period will amount to $195,000.  Terms of the modification are as follows:
 
1.      The required rent (Section 4) shall be decreased by $3,000 for the final year of the contract, 2009; and by $2,000 each year of the 2 additional renewable option years, 2010 and 2011; for a total annual payment of $37,000 for 2009, $40,000 for 2010 and $42,000 for 2011.  
2.      The required rent (Section 4) payment installments shall be changed from 8 equal installments (March to October) to 6 equal installments (May to October).
3.      All other terms and conditions remain the same for Turnberry Food Concessions by En-Course Catering, Inc.
 
We believe these negotiated changes are in the best interests of our golfing customers.  Weather and economic times have had an impact and through this, En-Course Catering, Inc. has continued to serve our golfers without delay or complaint.  
 
The Contract Compliance Number for En-Course Catering, Inc. is #203326047.  The expiration date is March 9, 2011.
 
Fiscal Impact:  
Revenue is decreased for 2009, 2010 and 2011 and revenue funds will be paid to Golf Course Operations Fund 284; Department 51-03; revenue OCA code 025866-Turnberry Golf Course.
 
2009 decreased by $3,000; for a total payment of $37,000; paid in 6 equal installments May-October, 2009
2010 decreased by $2,000; for a total payment of $40,000; paid in 6 equal installments May-October, 2010
2011 decreased by $2,000; for a total payment of $42,000; paid in 6 equal installments May-October, 2011
 
Emergency legislation is required as this affects the timing of the revenue generating contract and the payment to the city.  It also affects En-Course Catering, Inc. and their ability to conduct business and entertain new opportunities as a result of this modification.

To authorize and direct the Recreation & Parks Director to modify the food concession contract (revenue) at Turnberry Golf Course with the food concessionaire En-Course Catering, Inc.; and to declare an emergency.
 
 
Body
 
    WHEREAS, one (1) bid was received by the Department of Recreation and Parks and evaluated on for a food service contract at Turnberry Golf Course; and
 
    WHEREAS, the recommendation was made to award the contract to En-Course Catering, Inc. for a period of three (3) years with an option to renew annually for an additional two (2) years; and
 
    WHEREAS, it is in the best interest of the Department of Recreation and Parks to modify the contract with En-Course Catering, Inc. as specified in the background above; and
 
    WHEREAS, an emergency exists in the usual daily operation of the Recreation and Parks Department and that it is immediately necessary to modify said contract this affects the timing of the revenue generating contract and the payment to the city.  It also affects En-Course Catering, Inc. and their ability to conduct business as a result of this modification, now therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
    SECTION 1.  That the Director of Recreation and Parks be and he is hereby authorized and directed to modify the revenue generating contract, CT01132R, with En-Course Catering, Inc. for food service at Turnberry Golf Course, in accordance with the specifications on file in the Recreation and Parks Department.
 
    SECTION 2.  Revenue payments will be decreased and made to the Golf Course Operations Fund No. 284; Department 51-03; OCA Code 025866-Turnberry Golf Course as follows:  2009 decreased by $3,000 for a total payment of $37,000; 2010 decreased by $2,000 for a total payment of $40,000 and 2011 decreased by $2,000 for a total payment of $42,000.
 
    SECTION 3.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten  (10) days after passage if the Mayor neither approves nor vetoes the same.
