Title: To authorize and direct the Finance Director to modify and extend the city-wide contracts for the option to purchase Building Electrical Products, with Wesco Distribution Inc, Loeb Electric Company, Edco Tool & Supply, Consolidated Electrical, Becker Electric Supply, Rexel Elgee Inc., Electrical Mechanics and McNaughton-McKay Electric, and to declare an emergency.
Explanation
 
BACKGROUND:  To modify and extend existing city-wide contracts for the option to purchase Building Electrical Products for Purchasing Office to and including November 30, 2004.  Formal bids were opened by the Purchasing Office on October 12, 2000. The Purchasing Office advertised and solicited competitive bids in accordance with Section 329.06. (Proposal No. SO001877BGB). Contracts FL000612, Wesco Distributions Inc, CC#251723345; FL000611, Loeb Electric Company, CC#314236750; FL000610, Edco Tool & Supply, 34-1040573; FL000609, Consolidated Electrical, 95-2563864; FL000606, Becker Electric Supply, CC#31-0553243; FL000607, Rexel Elgee Inc., CC#64-0283323; FL000862, Electrical Mechanics, CC#31-1274252; and FL000608, McNaughton-McKay Electric, CC#38-3301318 were established in accordance with bids received.
 
1. Amount of additional funds:  No additional funding is needed to extend contracts. The agencies must obtain approval to expend from their own budgeted funds for their estimated expenditures ($410,000.).
2. Reason additional needs were not foreseen: Needs were foreseen, an extension is provided for in the original contract.
3. Reason other procurement processes not used: The same exact product is required as originally bid. No lower pricing/more attractive terms and conditions are anticipated at this time.
4. How cost was determined: The cost, terms and conditions are in accordance with original agreement.
FISCAL IMPACT: No funding is required to extend the option contracts. Each agency must set aside their own funding for their estimated expenditures.
 
The two companies for which we estimate expenditures in excess of $100,000 per year, Loeb Electric, and McNaughton-McKay Electric, are not debarred according to the Excluded Party Listing System of the Federal Government.
 
In order to provide uninterrupted service and supply this ordinance is being submitted as an emergency.

Body
 
WHEREAS, the Purchasing Office advertised and solicited formal bids, and selected the lowest bid; and
 
WHEREAS, vendors have agreed to extend FL000612, FL000611, FL000610, FL000609, FL000606, FL000607, FL000862, and FL000608 at current prices and conditions to and including November 30, 2004, and it is in the best interest of the City to exercise this option; and
 
WHEREAS, an emergency exists in the usual daily operation of the Purchasing Office in that it is immediately necessary to extend FL000612, FL000611, FL000610, FL000609, FL000606, FL000607, FL000862, and FL000608 for an option to purchase Building Electrical Products thereby preserving the public health, peace, property, safety, and welfare, now, therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1. That the Finance Director be and is hereby authorized and directed to modify and extend FL000612 with Wesco Distribution, Inc., FL000611 with Loeb Electric Company, FL000610 with Edco Tool & Supply, FL000609 with Consolidated Electrical, FL000606 with Becker Electric, FL000607 with Rexel Elgee, Inc., FL000862 with Electrical Mechanics, and FL000608 with McNaughton-McKay Electric to and including November 30, 2004.
 
SECTION 2. That this modification is in accordance with Section 329.16 of the Columbus City Codes.
 
SECTION 3. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
