BACKGROUND:
This ordinance will authorize the Director of Recreation and Parks to modify existing contract EL008110 with The Columbus Downtown Development Corporation for the administration of the Scioto Mile Development Project known as the Scioto Mile in the amount of $9,019,500.00.
Pursuant to Ordinance No. 1746-2009 the City entered into a contract with Columbus Downtown Development Corporation for the construction of the Scioto Mile Park and authorized the expenditure of an initial $5,000,000 and an additional $5,000,000 subject to future ordinances of council. This ordinance will provide the additional $5,000,000.00 in Voted Bond funding and $4,019,500 in grant funding, from the Ohio Department of Natural Resources ($3,019,500) and the Ohio Cultural Facilities Commission ($1,000,000) under grant agreements authorized by Ordinance Nos. 1364-2009 and 1337-2009, respectively. These expenditures will be used to pay a portion of the cost of construction of the Park and related services currently under way by Columbus Downtown Development Corporation.

Emergency action is necessary to allow Columbus Downtown Development Corporation to continue work as plans for the park are moving forward.
FISCAL IMPACT:
The expenditure of $9,019,500.00 is budgeted in the Recreation and Parks Voted 1999/2004 Bond Fund
"contingent on bond sale fund proceeds" ($5,000,000), ($3,019,500) and ($1,000,000) in grant funding are also budgeted and appropriated by previous legislation ord. #1364-2009 and 1337-2009.

WHEREAS, it is necessary to modify contract EL008110 with the Columbus Downtown Development Corporation for the administration of the Scioto Mile Development Project to provide additional funding and to require Columbus Downtown Development Corporation to comply with additional construction obligations imposed under the grant agreements; and
WHEREAS, an emergency exists in the usual daily operation of the Recreation and Parks Department in that it is immediately necessary to enter into said contract for the preservation of public health, peace, property and safety; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Director of Recreation and Parks be and he is hereby authorized and directed to modify contract EL008110 contract with the Columbus Downtown Development Corporation for the administration of the Scioto Mile Development Project from Battelle Park to Bicentennial Park.
SECTION 2. That to pay the cost of said contract modification, the expenditure of $9,019,500.00 or so much thereof as may be necessary, be and is hereby authorized from the Recreation and Parks Voted Bond Fund No. 702/746, Department 51-01, as follows:

SECTION 3. That the monies in the foregoing Section 2 shall be paid upon order of the Director of Recreation and Parks, and that no order shall be drawn or monies paid except by voucher, the form of which shall be approved by the City Auditor.
SECTION 4. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
SECTION 5. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
