Explanation
1.  BACKGROUND
This ordinance authorizes The Director of Public Service to enter into agreements with the Ohio Department of Transportation (ODOT) for 3 roadway improvement projects.  They are as follows:
 
The first project will perform partial depth repairs, plane and resurface pavement with asphalt concrete, and replace pavement marking and loop detectors. Overall Project Limits extend on US 40 (Broad Street) from the US 42 interchange in Madison County to east of Galloway Road in Franklin County (approximately 12 miles). The portion of the project which is located in Columbus is from west of Doherty Road to east of Galloway Road (approximately 0.4 miles). (MAD/FRA-40-7.84/0.00 PID 76356)
 
This is an Ohio Department of Transportation resurfacing project and there is no new curb ramps, sidewalks or bike paths associated with the City of Columbus portion of this project to be constructed.   All existing bus stops will be preserved and/or maintained and maintenance of traffic plans take into account active bus stops for the project throughout construction.
 
The second project will perform partial depth rehabilitation, plane and resurface pavement with asphalt concrete, and replace pavement marking and loop detectors. Project Limits extend on East Broad Street (SR-16) from the West Columbus Corporation Line at Gould Road to the East Columbus Corporation Line east of Napolean Avenue. Project length is 1.03 miles. 98 ADA curb ramps will be added or reconstructed in these project limits as part of this project.

The third project proposes to resurface DEL-750 (Polaris Parkway) from South Old State Road to Lyra Drive.  The scope of work is to perform partial depth pavement reconstruction; plane and resurface pavement with asphalt concrete; and replace pavement markings and loop detectors. 43 ADA curb ramps will be added or reconstructed in these project limits as a separate project.

2.  EMERGENCY DESIGNATION
Emergency action is requested in order to meet ODOT's schedule for these projects, some which will occur as early as February.  In order to do this paperwork needs to be returned to ODOT in February, 2010.  
 
3.  FISCAL IMPACT
The estimated  City share for these projects is $810,104.00, but the estimated amount will be adjusted so that the City's ultimate share of the cost of these improvements shall correspond with the actual cost when said actual costs are determined.  The estimated City cost for the US 40 (Broad Street) project, pid 76356 is $28,387.00.  The estimated City cost for the East Broad Street (SR-16) project, PID 79360, is $591,932.00.  The estimated City cost for the Polaris Parkway (DEL-750) project, PID 81909, is $345,788.00.
 
Funds for the City's share of these projects are budgeted in the 2009 C.I.B. and available within the Gov'l Build America Bonds Fund.  
 
Title

Body
The following ordinance enacted by the City of Columbus, Ohio, hereinafter referred to as the Legislative Authority or Local Public Agency or "LPA", in the matter of the stated described projects.
 
WHEREAS, on the 15th day of December, 2008, the LPA enacted legislation (Ordinance 1800-2008) proposing cooperation with the Director of the Ohio Department of Transportation (Director of Transportation) for the described project:
 
On US 40 perform pavement reconstruction and resurfacing.
Overall Project Limits extend from the US 42 interchange in Madison County to east of Galloway Road in Franklin County. The portion of the project which is located in Columbus is from west of Doherty Road to east of Galloway Road; and
 
WHEREAS, on the 30th day of March, 2009, the LPA enacted legislation (Ordinance 0227-2009) proposing cooperation with the Director of the Ohio Department of Transportation (Director of Transportation) for the described project:
 
This project proposes to perform pavement reconstruction and resurface pavement on East Broad Street from the Columbus Corporation Line at Gould Road to the Columbus Corporation Line east of Napoleon Avenue; and
 
WHEREAS, on the 6th day of April, 2009, the LPA enacted legislation (Ordinance 0298-2009) proposing cooperation with the Director of the Ohio Department of Transportation (Director of Transportation) for the described project:
 
This project proposes to perform pavement reconstruction and resurface pavement on DEL-750 (Polaris Parkway) from South Old State Road to Lyra Drive; and
 
WHEREAS, the LPA shall cooperate with the Director of Transportation in the above described projects as follows:
 
The City agrees to assume and bear one hundred percent (100%) of the entire cost of  the improvement, less the amount of Federal-aid, and State funds set aside by the Director of Transportation of the State of Ohio for the financing of this improvement from funds allocated by the Federal Highway Administration, U.S. Department of Transportation, and further, the City agrees to assume and bear one hundred percent (100%) of the cost of Preliminary Engineering and Right of Way, excluding in-house preliminary engineering and Right-of-Way charges incurred by the State.
 
Also, the City agrees to assume and bear the entire cost and expense of the installation and/or repair of curb ramps which are necessary to ensure compliance with the Americans with Disabilities Act.  
 
The share of the cost of the LPA is now estimated in the amount of Nine Hundred Sixty Six Thousand One Hundred Seven and 00/100 Dollars, ($966,107.00) for these projects, but said estimated amount is to be adjusted in order that the LPA's ultimate share of said improvements shall correspond with said percentages of actual costs when said actual costs are determined; and
 
WHEREAS, the Director of the Ohio Department of  Transportation has approved said legislation proposing cooperation and has caused to be made plans and specifications and an estimate of cost and expense for improving the above described highway and has transmitted copies of the same to this legislative authority; and
 
WHEREAS, the LPA desires the Director of Transportation to proceed with the aforesaid highway improvements; and
 
WHEREAS,  an emergency exists in the usual daily operation of the Department of Public Service, Division of Design and Construction, in that it is the sense of this Council that the Director of the Ohio Department of Transportation must proceed with the aforesaid highway improvement, thereby preserving the public health, peace, property, and safety; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the estimated sum of Nine Hundred Sixty SixThousand One Hundred Seven and 00/100 Dollars, ($966,107.00),  or so much thereof as may be needed be and is hereby authorized to be expended from the Gov'l Build America Bonds Fund, Fund 746, Division of Design and Construction, Dept-Div. 59-12 as follows:

for the improvements described above and the fiscal officer is hereby authorized and directed to issue an order on the treasurer for said sum upon the requisition of the Director of the Ohio Department of Transportation to pay the cost and expense of said improvement.  We hereby agree to assume in the first instance, the share of the cost and expense over and above the amount to be paid from Federal funds.
 
Section 2.  That the 2009 Capital Improvements Budget established within ordinance 0806-2009 be and hereby is amended to provide funding for this project as follows:

Section 4.  That the LPA hereby requests the Director of Transportation to proceed with the aforesaid highway improvement.
 
Section 5.  That the LPA enter into a contract with the State, and that the Director of Public Service be and is hereby authorized to execute said contract, providing for the payment of the LPA the sum of money set forth herein above for improving the described projects.
 
Section 6.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
 
Section 7.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten day after passage if the Mayor neither approves nor vetoes the same
