Explanation
 
Background:  This legislation will authorize the Director of Recreation and Parks to enter into contract with Complete General Construction Company for the Olentangy Trail Emergency Erosion Repair.  A serious erosion slip is occurring along the trail on the west side of the Olentangy River approximately 200 feet north of the current Broadmeadows Bridge construction project.  This high bank erosion is threatening to wash out the trail.  Recreation and Parks became aware of the problem when construction started on the bridge project.  The contractor for the bridge project, Complete General Construction, proposed that they use the same stone causeway to repair the slip that they were using on the bridge project.  Not only would this save them from charging the project to remove the causeway, but it would be a cost effective solution to repair the erosion problem.  
 
A formal request was made to ODOT District 6 to issue a change order to Complete General authorizing the work.   However, ODOT refused the request  because they said that the repair was ineligible for a change order and was outside the project work.    The expected completion date for the project is April 20, 2008.  As such, the contractor has requested that Recreation and Parks authorize the repair because once the project is complete there will no longer be direct access to the wash out.  If the slip is not repaired in the near future, the existing bikepath will be undermined.
 
Upon further review by the project's engineers, they have determined that the price that Complete General has proposed to place 528 cu.yds. of dump rock is fair and reasonable to repair the erosion.  They have also indicated that once the SR 315 access is closed, this site will not be easily accessible.  As a result, the contractor would need to use much smaller trucks to move the rock which would increase our costs significantly.  Added to those costs would be a mobilization charge of between $5,000.00 and $10,000.00.  The project would be delayed even further because application would need to be made for a new waterway permit.   For these reasons, the Department is requesting that the formal bidding provisions of the Columbus City Code Chapter 329.06(b) be waived in order to enter into contract with Complete General Construction Company.
 
Emergency action is requested so that Complete General Construction Company can begin repairing the slip as soon as possible as the safe use of the Olentangy Trail is in jeopardy due to the erosion problem.
 
The Contract Compliance Number for Complete General Construction Company is #314366382 and the compliance date is effective through January 30, 2010.
 
Fiscal Impact:  The expenditure of $30,170.00 or so much thereof as may be necessary, be and is hereby authorized from the Recreation and Parks Voted Bond Fund No.; 702, Dept.; 51-01, OCA Code; 644526, Project No.; 510229:  Bikeway Improvements and Object Level 3 No. 6621, to pay the cost thereof.

Body
 
WHEREAS, a serious erosion problem is affecting the Olentangy Trail near Antrim Park/Broadmeadows Bridge causing a safety concern for our trail users; and
 
WHEREAS, it is important that work begin on the slip prior to completion of the Olentangy Trail Bridge Project; and
 
WHEREAS, it is in the best interest of the City of Columbus to waive the competitive bidding requirements of the Columbus City Code and contract with Complete General Construction Company due to the timeliness of the project and the significant cost savings having the on-site bridge contractor perform the work; and
 
WHEREAS, an emergency exists in the usual daily operation of the Recreation and Parks Department in that it is immediately necessary to enter into said contract so that the repair work can begin preventing a complete erosion of the bike trail; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.   That this Council finds it in the best interest of the City of Columbus to waive the requirements of competitive bidding for professional services for the Olentangy Trail Emergency Erosion Repair, and does hereby waive provisions of Section 329.06(b) of the Columbus City Codes.
 
SECTION 2.   That the Director of Recreation and Parks be and he is hereby authorized and directed to enter into contract with Complete General Construction Company for the Olentangy Trail Emergency Erosion Repair.
 
SECTION 3.   That the expenditure of $30,170.00, or so much thereof as may be necessary, be and is hereby authorized from the Recreation and Parks Voted Bond Fund No.; 702, Department; 51-01, OCA Code; 644526; Project No.; 510229:  Bikeway Improvements and Object Level 3; 6621, to pay the cost thereof.
 
SECTION 4.  That the City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project; except that no transfer shall be so made from a project account funded by monies from more than one source.
 
SECTION 5.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
 
SECTION 6.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
