Explanation
BACKGROUND:
This legislation authorizes the Director of the Department of Technology (DoT) and the Director of the Department of Public Utilities (DPU) to renew an annual agreement with Inflection Point Solutions, for annual maintenance and support of the Pretreatment Information Management System (PIMS) software system utilized by DPU in support of their compliance activities.  The original agreement (EL005446) was authorized by ordinance 1003-2005, passed June 20, 2005.  The agreement was most recently renewed by authority of ordinance 1879-2011, passed December 5, 2011, through purchase order EL012416.  This renewal will provide software maintenance and support services for the period January 1, 2013 through December 31, 2013 at a cost of $24,000.00.
The software is used to schedule and track pretreatment samples.  Information is shared between this software and the Laboratory Information Management System (LIMS), with regards to the results of the samples that are collected.  The fees for the license include support on the software on an as needed basis.
This ordinance also requests approval to continue services provided by Inflection Point Solutions, in accordance with sole source procurement provisions of Section 329 of the Columbus City Code.  It has been determined Inflection Point Solutions is the sole source of maintenance and support for the PIMS software system, and does not utilize re-sellers for this purpose.  
  
EMERGENCY:  
Emergency action is requested to ensure that the needed services are not delayed; thus reducing the risk of potential outage and or interruption in services associated with the necessary services requested.
 
FISCAL IMPACT:   
In 2010 and 2011, $24,000.00 per year was expended respectively with Inflection Point Solutions for annual maintenance and support of the Pretreatment Information Management System (PIMS) software system utilized by DPU.  Approval of this ordinance will allow for the expenditure of $24,000.00, to renew an annual agreement with Inflection Point Solutions, for annual maintenance and support.  Funding for this purchase in the amount of $24,000.00 is available within the Department of Technology, Internal Services Fund, direct charge budget for DPU.  Including this renewal, the aggregate contract total amount is $411,139.41.

WHEREAS, this renewal will provide software maintenance and support services for the period January 1, 2013 through December 31, 2013 at a cost of $24,000.00; and
WHEREAS, this ordinance also requests approval to continue services provided by Inflection Point Solutions, in accordance with sole source procurement provisions of Section 329 of the Columbus City Code.  It has been determined Inflection Point Solutions is the sole source of maintenance and support for the PIMS software system, and does not utilize re-sellers for this purpose; and
WHEREAS, an emergency exists in the usual daily operation of the City, in that it is immediately necessary for the Director of the Department of Technology and the Director of the Department of Public Utilities, to renew an annual agreement with Inflection Point Solutions, for annual maintenance and support of the Pretreatment Information Management System (PIMS) software system utilized by DPU in support of their compliance activities, so that there is not any interruption in the support of the software application, for the immediate preservation of public health, peace, property and safety; now, therefore:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1:  That the Director of the Department of Technology and the Director of the Department of Public Utilities be and is hereby authorized to renew an annual agreement with Inflection Point Solutions, for annual maintenance and support of the Pretreatment Information Management System (PIMS) software system utilized by DPU in support of their compliance activities.  This renewal will provide software maintenance and support services for the coverage period from January 1, 2013 through December 31, 2013 at a cost of $24,000.00.
 
SECTION 2:  That the expenditure of $24,000.00 or so much thereof as may be necessary is hereby authorized to be expended from:

SECTION 3:  That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated and the City Auditor shall establish such accounting codes as necessary.
 
SECTION 4:  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
 
SECTION 5:  That this agreement is being established in accordance with the sole source provisions of the Columbus City Code, Section 329.07.
 
SECTION 6:  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure, and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
